<br />Planning Commission Minutes <br />August 9, 1995 <br /> <br />closed the public hearing. <br /> <br />Resolution 8/9/95a <br /> <br />Chairman Wietecki offered the following motion which was seconded by Member <br />Harms. <br /> <br />WHEREAS, Burlington Northern Railroad right-of-way forms the front or south <br />property line along the structure and lot at 337 South Owasso Boulevard, and <br /> <br />WHEREAS, the front or south side setback from the Burlington Northern railroad right- <br />of-way front property line is five feet, and <br /> <br />WHEREAS, the Burlington Northern railroad right-of-way prohibits further <br />encroachment or further development, and <br /> <br />WHEREAS, the lot area is consistent with adjacent properties, and the proposed structure <br />will be set back from the shoreland a distance similar to adjacent structures, and <br /> <br />WHEREAS, the proposed structure would encroach no closer than the existing <br />structurally unsound structure to Lake Owasso's shoreline, now <br /> <br />THEREFORE, BE IT RESOLVED, that the City of Roseville Planning Commission <br />recommends approval of a variance to John Torgerson at 337 South Owasso Boulevard, <br />to allow the existing structure to be tom down and a new structure to be built at the same <br />21 foot setback from the shoreline for the foundation wall of the house and with a 15 feet <br />setback from the Lake Owasso shoreline for the deck, and 5 feet for the south or front <br />property line setback for a garage, but requiring a 5 foot minimum setback on both side <br />lot property lines. <br /> <br />ROLL CALL: <br /> <br />Ayes: Wietecki, Harms, Sandstrom, Rhody, Cunningham <br />Nays: None. <br /> <br />Chairman Wietecki explained that this case was a special case in an older, previously <br />developed area with preexisting lots of record. <br /> <br />6. <br /> <br />(h) <br /> <br />Planninl: File 2779: L&R Automotive's request for a special use permit for a <br />light automotive repair facility at 3011 Rice Street was moved to the Consent <br />Agenda. <br /> <br />14 <br />
