<br />Planning Commission Minutes <br />September 13. 1995 <br /> <br />Member Harms stated she was opposed to the driveway on Owasso, and recommended 1 <br />driveway on Rice Street that was wider than those normally shown. She recommended no <br />expansion of the building, and that the screening of the building and the site is acceptable. <br /> <br />Member Thein stated that there already was an adequate number of vehicles on Owasso <br />Boulevard, and recommended no driveway onto Owasso Boulevard. He expressed concern <br />with the ability to administer the conditional use permit regarding storage, contamination and <br />fumes from tune-ups, as well as sound and chemicals from the site. <br /> <br />Member Wall stated he was not clear whether this project had a negative impact on market <br />value and health, safety and welfare. He expressed concern about the height of the building. <br /> <br />Member Sandstrom asked for details regarding what are the permitted uses on this site. The <br />staff responded that most retail/commercial uses are permitted on this site including a sit- <br />down restaurant. Such permitted uses do not require an impact statement or a conditional <br />use permit. <br /> <br />MOTION: Member Wietecki moved, seconded by Member Rhody to recommend approval <br />of the L&R conditional use permit to establish an automotive repair business at 3011 Rice <br />Street with the following conditions: <br /> <br />1. The driveway must be in conformance with the city standards along South Owasso <br />Boulevard. <br />2. Any expansion of the building must occur by an amendment to the conditional use <br />permit only. <br />3. No single car may remain on the site for more than 5 days. <br /> <br />Member Wall discussed the motion and noted that it violates zoning ordinance Sections <br />1013.01 in which the Commission did not consider health, safety, and welfare, and impact <br />on adjoining properties. Member Cunningham stated he would like to hear comment from <br />the neighbors ofL&R's operation located in Little Canada. Member Wietecki responded that <br />the Commission is not approving the landowner, but the land use. <br /> <br />Roll Call: <br /> <br />Ayes: Thein, Sandstrom, Rhody, Wietecki <br />Nayes: Wall, Harms, Cunningham <br /> <br />Member Harms stated she voted against the motion because she wanted no entrance along <br />South Owasso Boulevard. Member Cunningham stated he voted against the motion because <br />of the poor impact this project would make on the area, and because there are repair shops <br />already along Rice Street.
