That the staff adhere to Section 1010.09 regarding landscaping and screening. <br /> <br />Member Harms stated this was a good project which would be an improvement to the <br />vacant building. The motion carried 4-1 with Member Wall opposing. <br /> <br />Roll Call: <br /> <br />Ayes: <br /> <br />Sandstrom, Harms, Cunningham, Thein <br /> <br />Nayes: <br /> <br />Wall <br /> <br />Member Wall stated he opposed the proposal because he felt that this was not the best use <br />ofthe site. He challenged the staff and the applicant to promote the site, and expressed <br />concern over which criteria would be used to promote the site. <br /> <br />6. <br /> <br />(b) <br /> <br />Plannine File 2792: Kenneth Clausen requests a conditional use permit for a <br />coffee kiosk at 1515 West County Road B. <br /> <br />Chairperson Harms opened the public hearing and requested Michael Falk to provide a <br />background report. Mr. Falk explained that the proposed use of the site would be a coffee <br />kiosk approximately lOx 8 feet in size with 2 employees. The site to be used is the <br />parking lot of the Target Store adjacent to County Road B. The zoning on this site is SC <br />Shopping Center and a conditional use permit is required for such uses. City Planner <br />Falk provided a video presentation looking at the parking lot, the traffic, and the health <br />issues. He noted the building will not be plumbed and that only electrical services will be <br />installed. The building will use the Target Store as a commissary for hot water and other <br />materials, as well as sanitizing equipment. Mr. Falk explained the parking requirements. <br />He explained that currently the Target site is 5.4 spaces per 1,000 sq. ft. of store area. <br />This is in excess of the city's standard. The hours of operation will be 6:00 a.m. to 7:00 <br />p.m. <br /> <br />The staff recommended approval of the conditional use permit. <br /> <br />Member Wall asked if the six criteria had been reviewed. (The staff said yes.) Member <br />Thein asked if this project was originally from the Apple Valley High School and, <br />secondly, whether water was to be brought to the shop or piped in. <br /> <br />Member Harms asked what would happen if the building was vacated. Mr. Falk <br />explained the building can be removed from the site as a portable building. The site <br />would then revert back to a parking lot. The Commission discussed whether a <br />conditional use permit can be written to take care of a lapse or a vacation in the site by <br />such a use to eliminate the conditional use permit. The staff responded that it could be <br />written into the conditional use permit, itself. <br /> <br />4 <br />
