<br />Planning Commission Minutes <br />March 13, 1996 <br /> <br />Vice Chairperson Harms opened the public hearing and requested a staff report. <br />Assistant Community Development Director, Rick Jopke, summarized a background <br />written report dated 3/13/96. Staff recommended denial of the request because the <br />request is not consistent with the City's Comprehensive Plan. The eastern parcel of the <br />project is designated as residential, not for business uses. Member Rhody asked for <br />clarification regarding traffic on Autumn A venue and for clarification regarding the types <br />of uses which could occur in a B-1 zone. <br /> <br />Tim Nelson, of Everest Development, representing Kath Oil, explained the project in <br />detail. Nelson explained that the applicant has held numerous meetings with neighbors <br />surrounding the site and found that most of the neighbors have been supportive. Bruce <br />Kath, applicant and owner of the site, explained the background and history of the site. <br /> <br />Member Wilke stated the car wash may be a concern and could it be taken out of the <br />project. Kath responded that it is a vital part of the project. Kath explained that the peak <br />hours of use are from 7:00 a.m. to 9:00 a.m. and from 4:00 p.m. to 6:30 p.m. This will be <br />his 9th store. The car wash will be partially shut down at 9:00 p.m. and will use closed <br />doors during the car wash cycle. There will be no 24 hour service and no video on the <br />site. Camera surveillance of the entire site, inside and outside, will be present. The <br />business will be open from 5:00 a.m. until 12:00 midnight each day. There is a <br />possibility that a Subway Store, which is currently located on Lexington and Larpenteur <br />Avenue may move to the Kath site. Seating inside now is available for 12 people. <br /> <br />Member Sandstrom asked for details on decibel levels of the car wash. Tim Nelson <br />responded that the car wash decibels, with the doors closed, is 62 decibels, at one foot <br />from the door, where approximately 50 decibels at 25 feet from the door. <br /> <br />Paul Nerum, 1056 Roselawn, asked for clarification regarding vacuum cleaners and air <br />compressors. Tim Nelson responded that air compressors will be inside the building and <br />the vacuum will be placed along the frontage on Lexington Avenue. <br /> <br />Mike McGregor, 1123 Roselawn, asked for the number of pumps (16 fueling spots). <br />There will be speakers used for emergency use and there will be credit card machines at <br />the pumps. <br /> <br />Art Hutchinson, 1128 Autumn, expressed concern about the amount of traffic and left <br />turns from Autumn onto Lexington and from Lexington onto the site. <br /> <br />Al Schreiber, 701 Emerald Drive, who owns the two II-unit apartment buildings just <br />south of the site, stated that he was not notified of the hearing and none of the applicants <br />have spoken to him. He expressed concern about people moving out of his property if <br />this project continues. <br /> <br />Carol Wagner, 1148 Autumn, asked for details about the timing ofthe traffic study. <br /> <br />5 <br />
