Motion: <br /> Member Mulder moved, Member Harms seconded, to recommend <br />approval of the McDonald request for a conditional use permit to allow the <br />construction and operation of a new take-out/self-service restaurant at 2075 <br />Snelling Avenue North, with the following conditions: <br />1.The site must be developed in accordance with the final plans (site plan <br />dated 1/12/98, grading and drainage plan (dated 1/12/98), utility plan <br />(dated 1/12/98), planting plan (dated 1/12/98), and building elevations <br />(dated 1/12/98) submitted and approved in conjunction with the request <br />for a conditional use permit. Minor variations from the approved plans <br />may be approved by the City’s Development Review Committee, under <br />the direction of the Community Development Director; however, any <br />substantial departures from the approved plans will require an <br />amendment to the conditional use permit. <br />2.Final grading and utility plans must be reviewed and approved by the <br />Public Works Director. An erosion control plan must be developed and <br />erosion control must be in place prior to grading of the site. Since the site <br />is less than 2.5 acres in size, it is unlikely that on-site ponding will be <br />required by the Rice Creek Watershed District; however, the applicant will <br />need to contact the District for permit requirements. <br />3.All site lighting, including lighting for the parking area and exterior <br />building lighting, must comply with the requirements of Section 1010.12 of <br />the City Code. <br />4.All signage for the project must comply with the requirements of Section <br />1009 of the City Code, including the size and location of wall signs, pylon <br />sign, and directional signs. <br />5.The sidewalk along the front of the property shall be improved and/or <br />replaced, at the applicant’s expense, if required by the City in conjunction <br />with site development. Pedestrian access must be provided from this <br />sidewalk to the front door of the building via a paved pedestrian surface. <br />6.Prior to a building permit being issued for redevelopment of the site, the <br />applicant shall post a landscape bond, letter of credit, or other security <br />acceptable to the City, in an amount equal to 150% of the cost of site <br />landscaping, street tree planting, and site restoration. The specific <br />amount of this security shall be determined by the Community <br />Development Director following completion of all site construction plans. <br />7.The applicant shall record the approved conditional use permit with the <br />Ramsey County Recorder prior to the issuance of any building permit or <br />within sixty days of approval, whichever is less (Section 1013.01-City <br />10 <br />
