building lighting, must comply with the requirements of Section 1010.12 of <br />the City Code. <br />4.All signage for the project must comply with the requirements of Section <br />1009 of the City Code, including the size and location of wall signs, pylon <br />sign, and directional signs. <br />5.The sidewalk along the front of the property shall be improved and/or <br />replaced, at the applicant’s expense, if required by the City in conjunction <br />with site development. Pedestrian access must be provided from this <br />sidewalk to the front door of the building via a paved pedestrian surface. <br />6.Prior to a building permit being issued for redevelopment of the site, the <br />applicant shall post a landscape bond, letter of credit, or other security <br />acceptable to the City, in an amount equal to 150% of the cost of site <br />landscaping, street tree planting, and site restoration. The specific <br />amount of this security shall be determined by the Community <br />Development Director following completion of all site construction plans. <br />7.The applicant shall record the approved conditional use permit with the <br />Ramsey County Recorder prior to the issuance of any building permit or <br />within sixty days of approval, whichever is less (Section 1013.01-City <br />Code). <br />8.The conditional use permit shall expire within six months of the date of <br />City Council approval if a building permit is not obtained for the approved <br />development (Section 1013.03 of the City Code). <br />9.The applicant and/or underlying property owner shall grant an access <br />easement along the western edge of the property to the City in order to <br />provide a public access from County Road B south to the McDonald’s <br />property. <br />Craig Bornes and Steve Halvorsen expressed concern about item 9 in <br />conditions. They are concerned about granting an easement at this time when <br />other properties do not have a two-way access available to the north. Arby’s <br />and KFC will block the access because of their drive-thru lanes. <br />Chairperson Wietecki noted there is a problem, a need for the easements, but <br />asked if McDonalds would cooperate if all property owners would allow access <br />for their sites. It is not clear how much traffic would enter McDonalds for use of <br />the north/south accessway. An improvement would be an east/west access as <br />well. <br />There being no further comments from the public, Chairperson Wietecki closed <br />the hearing. <br />9 <br />
