Motion: <br /> Member Rhody moved, Member Wilke seconded, to recommend <br />approval of the request for a variance from Section 1011.02 to allow the <br />construction of a 12' x 32' addition to a non-conforming residential structure on a <br />lakeshore lot at 257 McCarrons Boulevard, based on the following staff findings <br />and pending approval from the Minnesota Department of Natural Resources, <br />and with the following provision: <br />A plan for adding vegetative screening on the house from Lake <br />McCarrons must be submitted to the City for review in conjunction with the <br />plans for a building permit, and such vegetation must be installed in <br />conjunction with construction of the addition. <br />Findings: <br />1)Section 1016.16 of the City Code requires a setback of 75 feet <br />from the ordinary high water level of McCarrons Lake. For this <br />reason, the existing structure on the property is nonconforming <br />because it is only setback 10 feet from McCarrons Lake. <br />2)Section 1011.02 of the City Code does not allow the expansion of a <br />non-conforming structure, although Section 1016.22 does allow <br />additions to non-conforming lakeshore lots if the addition meets the <br />setback requirements. The proposed addition will be on the <br />roadway side of the structure and will not reduce the setback of the <br />structure from the ordinary high water level of McCarrons Lake. <br />3)The property was granted a variance from the front yard setback <br />requirements in 1969 for the purpose of constructing the house in <br />its current location. The proposed addition will not extend beyond <br />the established building setback of 27.5 feet from the southern <br />edge of the South McCarrons Boulevard right-of-way. <br />4)The substandard size of the parcel creates a physical hardship for <br />? <br />the applicant. The applicants need for an accessible bedroom and <br />bathroom on the main floor creates a practical difficulty. <br />5)The proposed variance is in harmony with the general purpose and <br />intent of the City’s Comprehensive Plan and Title 10 of the City <br />Code (Zoning). The proposed addition will not extend beyond the <br />established building line along South McCarrons Boulevard or <br />reduce the setback of the structure from the ordinary high water <br />level of McCarrons Lake. <br />6)The proposed variance, if granted, will not adversely affect the <br />public health, safety, or general welfare. <br />10 <br />
