Motion carried 6-0.
Ayes:Mulder, Olson, Wilke,Rhody,Klausing,Harms
Nays: None
6e.Planning File 3057. Roger Krause is requesting a variance to increase the
coverage of the required rear yard from 25% to 37.5% for the purpose of
constructing a 26' x 26' (676 sf) garage at 1306 Ryan Avenue West.
Chair Harms opened the hearing and requested Dennis Welsch present a
summary, based on written reports of July 8, 1998, of the variance request for
construction of a garage at 1306 Ryan Avenue West.
DennisWeslch defined the variances as a driveway setback variance of 2',
building size variance of 226 s.f., and a lot coverage variance of 12.6% and
reviewed the hardship involved. The staff recommended approval.
LarryHolms, representing the applicant, reviewed the request.
There being no further questions or comments, Chair Harms closed the hearing.
Motion:
Member Mulder moved, Member Rhody seconded, to recommend
?
approval of Roger Krauses request for a variance to increase the lot coverage
to 37.5% of the required rear for the purpose of constructing a 26' x 26'
replacement garage at 1306 Ryan Avenue West and a variance to reduce the
setback of a driveway to three feet for the purpose of bringing an existing
driveway into compliance and allowing the extension of said driveway to access
the new garage, based on the following findings:
1)Section 1004.01(A) of the City Code limits the size of an accessory
building to 25% of the required rear yard, which limits the size of a
detached garage on this property to 450 square feet. The proposed
garage will be 676 square feet in area (37.6% of the required rear yard).
2.The pre-existing, non conforming width of the parcel creates a physical
hardship for the applicant; it limits the size of an accessory building to 450
square feet. (A standard, newly created lot would be 85 feet in width and
allow for approximately 635 square feet of accessory buildings.) The
substandard width of the parcel also creates a practical difficulty in
locating a driveway to access a detached garage.
3.The proposed variance is in harmony with the general purpose and intent
?
of the Citys Comprehensive Plan and Title 10 of the City Code (Zoning).
The location of the house on the parcel and the interior design of the
houseprohibits the construction of an attached garage of any size.
