<br />Nays: 0 <br /> <br />The following Planning Files (6b through 6f) are requests for variances from Section 703.04 of the City Code to enable the <br />applicants to maintain their respective existing non-conforming driveways. The requests were prompted by the City's 1999 <br />street improvements program (part of the Pavement Management Plan): <br /> <br />Gb. Planning File 3120. Russell A. Dansare, 2752 Matilda Street: Request for a Driveway Access Point Setback <br />Variance <br /> <br />Russell Dansare requested a 17 -foot variance from Section 703.04 of the City Code to reduce the required <br />driveway access point setback from a street corner from 30 feet to 13 feet. <br /> <br />Chairman Craig Klausing opened the hearing and requested Thomas Paschke to provide a brief summary of the <br />staff report dated June 9, 1999. Thomas Paschke explained the variance process for driveways and setbacks. Mr. <br />Dansare's request is for a 17 -foot variance from the corner intersection to allow a 13-foot driveway apron setback <br />be continued in the same location. The relocation would require major modifications and hardship of the yard and <br />trees. Staff recommended approval. <br /> <br />Russell Dansare, 2752 Matilda, described the site. Member Cunningham asked about traffic on Matilda (light). <br />There were no comments from the public. Chair Klausing read a letter supporting the proposal from Marylis <br />Reeves. <br /> <br />There being no further comment, Chair Klausing closed the hearing. <br /> <br />Motion: Member Rhody moved, seconded by Member Klausing, to recommend approval of the request for a <br />variance from Section 703.04B(4) of the City Code to reduce the required driveway setback for property located at <br />2752 Matilda Street from 30 feet to 13 feet, or a 17 foot variance, based on the following findings from the staff <br />report dated June 9, 1999: <br /> <br />Section 1013.02 required the applicant to demonstrate a physical hardship and to demonstrate that no <br />practical alternatives exist that would reduce the need for a variance; <br /> <br />Relocating the access point to meet the 30 foot setback would require major modifications to the existing <br />driveway as it extends to the garage; <br /> <br />The proposed variance, if granted, will not adversely affect the public health, safety or general welfare, <br />provided standards/conditions are attached to insure that redevelopment of the site is completed in <br />accordance with the plans proposed by the applicant. <br /> <br />Ayes: 5 <br /> <br />Nays: 0 <br /> <br />Gc. Michael and Mary Dietz, request for a driveway setback variance for property located at <br />373 Maple Lane Court. <br /> <br />Chair Klausing opened the hearing and requested Thomas Paschke to provide a brief summary of the staff report <br />dated June 9, 1999. Staff recommended approval. Chair Klausing asked for details regarding the grade of the <br />driveway (a maximum of 10% slope). <br /> <br />Mary Dietz, 373 Maple Lane Court, noted the driveway slope is a pre-existing steep slope, but the slope faces <br />south. Some snow melts easily from this drive. Member Cunningham asked for details of the Code. <br /> <br />There being no further comment, Chair Klausing closed the hearing. <br /> <br />Motion: Member Rhody moved, seconded by Member Wilke, to recommend approval of the request for a variance <br />from Section 703.04B(4) of the City Code to reduce the required driveway setback for property located at 373 <br />Maple Lane Court from 30 feet to 21 feet, or a nine foot variance, based on the following findings in the staff report <br />dated June 9, 1999: <br /> <br />The Pavement Management Program and its reconstruction of Maple Lane Court have initiated this request; <br />
