<br />Motion: Member Mulder moved, seconded by Member Wilke, to recommend concept approval of the request to amend <br />PUD #1124 to allow the design and construction of a four story office/radio building totaling 40,000 square feet and a <br />single story parking deck based on the findings outlined in Section 3 of the project report and with the conditions outlined <br />in Section 4 of the project report dated September 8, 1999 (and listed below), and further, that the building design <br />aesthetics be kept in mind as the design is completed. <br />1. The site must be developed in accordance with the staff corrected plans submitted and approved in conjunction <br />with the request for an amendment to the approved planned unit development (site plan; grading, drainage, erosion <br />control, & utilities plan; concept landscape plan; building floor plan; and exterior building elevations all dated <br />08/26/99). Minor variations from the approved site plan may be approved by the City's Development Review <br />Committee, under the direction of the Community Development Director. However, any substantial departures from <br />the approved site plan will require another amendment to the planned unit development. <br />2. Final grading, storm sewer, and utility plans must be reviewed and approved by the City Engineer/Public Works <br />Director. Rice Creek Watershed District shall review and comment on the proposed grading/drainage plan. <br />3. A final landscape plan must be submitted to the City Landscape Architect for review and approval. <br />4. The erosion control plan must be submitted in conjunction with site development plan. <br /> <br />Ayes: 6 <br /> <br />Nays: 0 <br /> <br />Member Wilke asked if there had been additional design thought given to widening the turning lane movements along <br />Lydia at Snelling. Staff will refer this to engineering staff for details. <br /> <br />Gb. Planning File 3147. David Seaberg, 3104 Fairview Avenue North, is requesting a conditional use permit to allow <br />construction of an addition to an existing detached garage 208 square feet in size. The addition would create an <br />accessory building that is 987.88 square feet in size. <br /> <br />Chair Klausing opened the public hearing and requested Thomas Paschke to provide a summary of the project report. <br />Thomas Paschke explained the purposes and location of the addition to the existing accessory building. He explained the <br />conditional use permit impacts, noting that the building meets all setbacks. The staff recommended approval of the 208 <br />s.f. addition with no further addition. <br /> <br />Member Mulder asked for clarification of the shed vs. the accessory storage and the uses within the two structures. <br /> <br />Member Olson asked if there should be any screening from adjacent residential structures. Thomas Paschke noted this <br />structure is central to five lots with ten dwelling units. <br /> <br />Member Egli asked for clarification regarding additional exterior storage or other materials; how much could be allowed <br />based on this request. <br /> <br />Dave Seaberg, 3104 Fairview, explained that he addition will break up (aesthetically) the space on the accessory building, <br />which was originally the house on the site. A buffer could be created on the lot to the east which is also owned by Mr. <br />Seaberg. The accessory building has been improved with new siding, roofing, windows and structural improvements. Mr. <br />Seaberg maintains all ten units from this accessory building. He has 16,000 s.f. of grass on this parcel. The accessory <br />building is completely screened from the street. <br /> <br />Chair Klausing asked for details regarding ownership of the accessory building; is it part of 31 04 Fairview (Yes). <br /> <br />Tim Calahan, 3062 Shorewood Lane, asked for details regarding the front of the structure. <br /> <br />Mr. Seaberg asked for details regarding downspouts and gutters - which are only above the main doors. There is gravel <br />and grass surrounding the site. <br /> <br />There were no further public comments, therefore, Chair Klausing closed the hearing. <br /> <br />Motion. Member Cunningham moved, seconded by Member Mulder, to approve the request by Dave Seaberg, 3104 <br />Fairview Avenue, for a conditional use permit to construct a 8' x 26' (208 square feet) addition on to his existing 780 <br />square foot detached garage, based on the findings outlined in the project report of September 8, 1999: <br />1. The applicant proposes a 208 square foot addition onto the existing 779.88 square foot accessory building, <br />creating a structure 987.88 square feet in size. Staff interprets the Code to allow the existing attached 8 by 12 foot <br />(96 square feet) structure as a shed in a pre-existing condition. Thus, a conditional use permit per Section <br />1004.01 A.12 of the City Code is required for an accessory structure totaling a square footage between 865 and <br />1,008 square feet. <br />
