<br />Chair Klausing opened the hearing and requested City Planner Thomas Paschke to provide a verbal summary of the <br />project report dated September 13, 2000. <br /> <br />Thomas Paschke discussed the background, process and findings relating to the conditional use permit request for an <br />amusement business within the Hamline Center (Shopping Center Zone), 2807 Hamline Avenue. He indicated the <br />proposal was to convert 11,650 s.f. of the former grocery store space (a pre-existing and non-conforming building) to a <br />non-profit charitable gambling bingo hall operation; that Hamline Center total space is 74,220 s.f.; the Center was built in <br />1960 and currently has 15 uses; the proposal before the Commission incorporates changes only to the inside of the <br />building; there are no new outdoor parking or ponding proposals; anticipated parking needs are 120-150 spaces (off peak <br />time); anticipated hours of operation; that the bingo operation must be approved by the City and State; Kraus-Anderson <br />will be required to comply with the applicable requirements of Ordinance 1234 (24-hour shopping center ordinance) as <br />they plan to be open after 10:00 p.m.. Mr. Paschke also discussed considerations to be made by the Planning <br />Commission in reviewing a conditional use permit. <br /> <br />Chair Klausing: Definition of off-peak hours? Do we have an exact traffic count? Off-peak hours considered those <br />between 9:00 a.m. - 6:00 p.m.; there has not been a traffic count made for a bingo-type operation by the ITE. Deb Bloom, <br />Assistant Public Works Director, indicated a traffic impact review had been done for Hamline Avenue and it was <br />determined the additional traffic from the bingo operation would not adversely affect Hamline Avenue traffic flow. <br /> <br />Member Wilke: What are the hours of operation and are they the same as they currently are at the Knights of Columbus <br />site? Hours of operation will not change. Proposal is for Sunday 1 :00-1 0:45 p.m.; Monday 7:15-9:45 p.m.; Tuesday 10:30- <br />10:45 p.m.; Wednesday 12:30-10:45 p.m.; Thursday 7:00-10:45 p.m.; Friday 1:30-12:45 p.m., Saturday 1:30-12:45 p.m.. <br /> <br />Member Rhody: How does this operation relate to 24-hour shopping center ordinance? Proposal must have screening of <br />parking from residential areas; must comply with lighting, trash enclosure and HVAC screening requirements. <br /> <br />Member Olson asked about screening in relation to parking; Mr. Paschke advised it would not be necessary to screen for <br />Centennial Drive. <br /> <br />City Attorney, Joel Jamnik, indicated it had been determined that the bingo operation was most similar to an amusement <br />business (as defined in the zoning code), thereby necessitating the conditional use permit in a shopping center district. <br /> <br />Thomas Wratkowski, General Counsel for Kraus-Anderson Realty Company, discussed their proposal. He advised: 1) the <br />building had been vacant for seven years despite efforts to find an anchor tenant; 2) the bingo operation had been in <br />Roseville for 15 years (currently leasing Knights of Columbus site which will have to be vacated by November 15, 2000); <br />3) charitable gambling would consist only of bingo and pull tabs; 4) the four organizations conducting charitable gambling <br />would continue to do so and discussed hours of operation (21 bingo sessions). <br /> <br />Karen Olson, Manager of Midway Speed Skating (one of the four charitable gambling organizations), advised the <br />Commission they had met with Hamline House tenants to discuss the proposal; the general operations of the <br />organizations and their respective contributions to Roseville; that they did serve food, but no alcohol; their anticipated <br />hours of operation. <br /> <br />Elaine Heisterkamp, Hamline House condo resident for 20 years, expressed residents' concerns about the center (noise, <br />odors, traffic). the lack of notice to residents about the hearing and urged the Commission to take more time to review the <br />proposal. <br /> <br />Discussion ensued as to if an additional hearing should be held and/or if additional notices should be mailed before <br />Council consideration. <br /> <br />Ervin Rice, Attorney at Law, Faegre & Benson, appeared on behalf of the Roseville Covenant Church. He advised the <br />Church had not received notice of this meeting; the Church opposed the operation on the basis that this was not an <br />appropriate site for this type of use; urged need for greater scrutiny; would have a negative impact of property value of the <br />church if allowed; questioned classification of the proposal as an amusement facility and impact of traffic volume on <br />Sunday mornings. <br /> <br />Joel Jamnik, City Attorney, reviewed the rationale for determination of the charitable gambling operation as most similar to <br />an amusement facility. <br /> <br />Chris Kringle, real estate agent, submitted a letter pertaining to alternative available sites for the bingo facility his <br />disagreement with allowing this type facility in a shopping center district and its effect on property values. <br /> <br />Mr. Rice advised the Covenant Church opposed the conditional use permit and requested denial of the application or <br />
