<br />Gb. Planning File 3252: A request by Susan Bruhn for a variance from the required rear yard setback to allow the <br />replacement of an existing (pre-existing, non-conforming) three-season porch on property located at 1983 Cleveland <br />Avenue. <br /> <br />Chair Klausing opened the hearing and requested City Planner Thomas Paschke to provide a verbal summary of the <br />project report dated September 13, 2000. <br /> <br />Thomas Paschke advised the request was for a variance from Section 1 004.02D (requiring a 30-foot rear yard setback for <br />principal structures) to allow for the replacement of a pre-existing non-conforming three season porch 13 feet into the <br />required rear yard setback (porch to be constructed 17' from the rear property line). Mr. Paschke discussed the conditions <br />and hardships due to the existing property limitations. <br /> <br />John Benneke, 1975 N. Cleveland indicated the original porch was constructed when the lot was 300' <br /> <br />There being no further questions or comments, Chair Klausing closed the hearing. <br /> <br />Motion: Member Mulder moved, second by Member Klausing to recommend approval of the Susan Bruhn request for a <br />13 foot variance for the existing home and screen porch, allowing the replacement of the existing porch to a size of 10 feet <br />by 17 feet (170 square feet), 13 feet into the required 30 foot rear yard setback. <br /> <br />Ayes: 6 <br /> <br />Nays: 0 <br /> <br />Motion passes. <br /> <br />Chair Klausing advised this recommendation would be before the City Council on September 25, 2000. <br /> <br />Gc. Planning File 3253. A request by Ted Brusen, Croix Oil Company, for a conditional use permit and variance to allow <br />the construction of an attached car wash on to the Fina gas station located at 1251 North Dale Street. <br /> <br />Chair Klausing opened the hearing and requested City Planner Thomas Paschke to provide a verbal summary of the <br />project report dated September 13, 2000. <br /> <br />Thomas Paschke discussed the request for a conditional use permit to expand a pre-existing non-conforming use by <br />constructing a 40' x 50' car wash and storage addition to the Fina gas station at 2151 Dale, and defined the variance <br />requests of the applicant. He advised the site was zoned B-3, defined the site size as well as surrounding properties. He <br />further advised there would be no new outdoor parking (14 spaces required) and reviewed the developer's proposals for <br />improvement of the site. <br /> <br />The variances being requested were for: 1) setback adjacent to the street - 8' existing, 7' variance requested; 2) setback <br />on west side yard - 5' existing, 3' variance requested; 3) driveway access (Dale Street) setback to corner - 40 feet <br />existing, 10' variance requested. <br /> <br />Mr. Paschke reviewed findings, comments and conditions relevant to the application. <br /> <br />Planning Commission members generally discussed the staff recommendation for elimination of two access drives. The <br />Commission discussed various re-designs for egress onto County Road B and Dale Street. <br /> <br />Ted Brausen, Manager/Operator of the station indicated he was attempting to improve the site and his only disagreement <br />with the staff recommendation was the closing of one of the access points (County Road B). His concern was due to <br />safety and the turning radius needed by tankers. Concern was expressed by Members as to adequate lighting of the site <br />and possible drainage problems from the car wash. <br /> <br />There being no further comment, Chair Klausing closed the hearing. <br /> <br />Motion: Member Klausing moved, second by Member Mulder, to recommend approval of the request by Croix Oil <br />Company for a conditional use permit to allow construction of a 2,000 square foot car wash with storage and enclosed <br />trash container area, based on the following findings and conditions: <br /> <br />Findings: <br />1. The proposed use will not have a significant impact on traffic, parks, or other public facilities, or on the general public health, safety and welfare; <br />
