<br />drive from North McCarrons Boulevard. Sewer and Water serve the house. <br /> <br />The Sladky request has been forwarded to the Department of Natural Resources (DNR) for review and comment. Staff <br />was able to review the request with Mr. Joe Richter of the DNR where the following items were discussed: Mr. Richter <br />indicated the DNR would not oppose the replacement in the exact location. However, he indicated a desire to have the <br />four-season porch reduced (would require smaller size) to lessen the impact of the shoreland setback or the option of <br />reconstruction the porch on the east side of the home. The DNR would like the Sladky's to look into these options, but <br />should they not be appropriate given existing conditions, the DNR would support the variance and porch replacement. <br /> <br />The parcel is odd shaped, has topographical limitations to the northeast and east, is restricted due to a city sewer line and <br />20 foot wide easement, and has no reasonable alternative. The former four-season porch and its current foundation are <br />pre-existing non-conforming uses. <br /> <br />The City is concerned with how the house is situated on the parcel and the potential of the home lying over the western <br />property line and possibly into the sewer easement. Although the sewer line was constructed many years after the home <br />was constructed, the house and lot are considered pre-existing non-conforming. However, staff considers these two items <br />critical. Should the home lie over the easement created for the sewer line, staff would have to review options to remedy <br />the matter. Further, should the house be located on the adjoining parcel, the Sladky's would be required to seek an <br />easement or acquire property to remedy the matter. <br /> <br />Member Rhody asked whether a smaller porch was considered. <br /> <br />Ms. Sladky said all plans are on hold, pending variance, and using the existing slab has always been the plan. <br /> <br />Chair Klausing asked for physical hardship description (non-conforming lot size, pre-existing non-conforming structure, <br />vegetation, slope, and east side utility easement). <br /> <br />Tom Holloway explained the contractor plans to do current work. <br /> <br />Member Cunningham asked if the new porch would be the same dimensions yes). <br /> <br />Chair Klausing closed the hearing. <br /> <br />Motion: Member Klausing moved, second by Member Cunningham, to recommend, with findings (non-conforming lot <br />size, pre-existing non-conforming structure, vegetation, slope, and east side utility easement), approval of the proposed <br />variance, subject to the provision of a survey of the parcel indicating all property line, easements, and structures as <br />follows: <br />A. A 2.1 foot (west) side yard setback; <br />B. Lot width variance of 52 feet at the shoreland <br />C. A Shoreland setback of 42 feet. <br /> <br />Ayes: 5 <br /> <br />Nays: 0 <br /> <br />Motion carried. <br /> <br />b. Planning File 3264: A request by David W. Kenney for a 13 foot variance from Section 1 004.02D (Minimum Yard <br />Requirements) of the Roseville Zoning Ordinance to allow construction of an attached garage in the front yard setback. <br />The property is located at 3062 West Owasso Boulevard. <br /> <br />David Kenney, 3062 West Owasso Boulevard North, requested a variance from Section 1 004.02D5 of the Roseville City <br />Code to allow the replacement of an existing detached garage with a larger (40 foot by 20 foot) detached garage with a <br />study expansion. The proposal requests keeping the 16.6 foot front yard setback, requiring a 13.6 foot variance. <br /> <br />Staff has reviewed the merits of the front yard setback variance to allow the Kenney's to proceed with their detached <br />garage replacement and study addition. Staff concluded that there are unique circumstances present on or effecting the <br />parcel and recommended approval of the request. <br /> <br />Member Wilke asked if the slab would be replaced (yes). <br /> <br />Member Olson asked for color of materials (match the house). <br />
