<br />encompasses approximately 5.2 acres, is zoned R-1 , Single Family Residential, and the Comprehensive Plan identifies <br />the property as Low Density Residential. Advent Lutheran Church desires to tear down their existing 308 square foot shed <br />constructed in 1954 and replace it with a 30-foot by 40-foot (1,200 square feet) accessory structure. The new structure <br />would better serve the Church and its auxiliary uses storage space needs. Staff recommended approval of the variance <br />and the conditional use permit with conditions. <br /> <br />Chair Mulder asked that a CUP condition be added to review the fire and building code compliance with the school on the <br />premises. <br /> <br />Pastor Tom Bassich agreed with the Chair regarding fire and building code and will also install windows as per the staff <br />recommendations. <br /> <br />Member Wilke asked if there was a driveway needed (there are existing driveways and parking). <br /> <br />Chair Mulder asked for details regarding the requirement for windows. Windows may create a safety issue. <br /> <br />There being no further comment, Vice Chair Jim Mulder closed the public hearing. <br /> <br />Motion: Member Olson moved, seconded by Member Duncan, to recommend approval of a 192 square foot variance <br />from Section 1004.01 A4 to allow construction of a 1,200 s.t. detached accessory building on property located at 3000 <br />Hamline Avenue, based on the comments and findings in Section 3, and 4 of the project report dated September 12, <br />2001. <br /> <br />Ayes: 6 <br /> <br />Nays: 0 <br /> <br />Motion carried. <br /> <br />Motion: Member Traynor moved, seconded by Member Cunningham, to recommend approval of a conditional use permit <br />to allow construction of a 30 foot by 40 foot (1,200 sq. ft.) detached accessory building for property located at 3000 <br />Hamline Avenue, based on the comments and findings in Section 3 and 5, and the conditions stipulated in Section 7 of <br />the project report dated September 12, 2001, with the building and fire code review of building conditions and separation <br />from the school. <br /> <br />Ayes: 6 <br /> <br />Nays: 0 <br /> <br />Motion carried. <br /> <br />(c) Planning File 3341: A request by Clinton Freeman, 1296 Woodhill Drive, for a variance to Section 1 012.02B2 of the <br />Roseville City Code for allowance of a fence in a front yard greater than four feet. <br /> <br />Chair Jim Mulder opened the hearing and requested Dennis Welsch to provide a verbal summary of the project report <br />dated September 12, 2001. <br /> <br />Dennis Welsch explained that Mr. Freeman owns the home located at 1296 Woodhill Drive. The property is zoned R-1, <br />Single Family Residential District with a Comprehensive Plan Designation of LR, Low Density Residential. The Freeman <br />property is surrounded by residential homes on the north, south, east, and west. To the southeast lies Howard Johnson <br />Park. The request includes a variance from Section 1 012.02B2 of the Roseville Zoning Ordinance to increase the height <br />of a fence in a front yard to six feet. The Freeman lot is a corner lot with frontage along Woodhill Drive and Huron Street. <br />The Freeman home is addressed off of Woodhill Drive, which under City Code is a side yard. The front yard, as <br />prescribed by the City Code, is that which fronts along Huron Street. In the case of the Freeman's the true front yard is <br />used as a side yard. The Freemans desire privacy and sound screen for their home and would like to construct a six-foot <br />tall fence from their south property line to the home. The fence would be set back approximately nine feet from the front <br />property line adjacent to Huron Street. <br /> <br />Based on the comments and findings outlined in Section 3 and 4 of the project report, staff recommended approval of the <br />request for a two foot height variance to Section 1 012.02B2 of the City Code, to allow the construction of a six foot tall <br />fence in a portion of the front yard of property located at 1296 Woodhill Drive. <br />
