<br />The Community Development Staff recommended approval of the request by Patrick Chierello for a modified Variance, <br />based on the comments and findings outlined in Section 4, 5, and 6 the City Staff for an 8 square foot variance (compared <br />to the requested 128 sq. ft.) from Section 1 004.01A5 and a conditional use permit to allow the construction of a detached <br />accessory building 896 square feet in size for property located at 2415 Dale Street, subject to the following conditions: <br />A. A maximum of one accessory building (detached garage) size of 32 feet wide by 28 feet deep or 896 square feet <br />on the site. <br />B. A maximum impervious surface coverage for the parcel of 3, 015 square feet. <br />C. A minimum side and rear yard setback of five feet. <br />D. The inclusion of windows on the north/south building face. <br />E. A maximum exterior wall height of nine feet, two inches, (9'2'J and a maximum garage door height of eight (8) feet. <br />F. The installation of roof gutters to properly channel roof drainage away from the adjacent (north & west) property. <br />G. A maximum building height of 15 feet to the midpoint of the roof and the installation of roof trusses that are of a <br />similar design to that of existing structure contiguous to the property. <br />H. The submittal and approval by the Community Development Department of a screening plan that incorporate <br />coniferous and deciduous landscaping and/or a solid wood fence on the north and west sides of the property to <br />screen and break up the mass of the structure. <br />I. The accessory structure being constructed of a similar color and with similar materials (vinyl) to that of the principal <br />structure. <br />J. The use of the detached accessory building (garage) being limited to residential storage and use only. <br />K. The existing detached garage and any shed or other accessory building being razed prior to the issuance of the <br />building permit to start construction of the new accessory structure. <br />L. The conditional use permit expires 6 months after approval if a building permit has not been issued (Section <br />1013.03). <br /> <br />Dennis Jarat, from Sussell Howes, explained that Mr. Chierello communicated with the neighbors. Mr. Chierello has a <br />business in Mounds View, wants to use the trailer for his vehicle and trailer storage and residential uses. <br /> <br />Mr. Chierello said he did understand that he would be limited to one accessory building and that was all he wanted on this <br />site. <br /> <br />Dennis Jarat noted that the garage and house would be sided in vinyl. <br /> <br />There being no further discussion, Chair Duncan closed the hearing. <br /> <br />Motion: Member Mulder moved, seconded by Member Duncan, to recommend approval of an 8 square foot variance <br />from Section 1004.01 AS to allow construction of a detached accessory building 8 square feet larger than the City Code <br />allows for property located at 2415 Dale Street, based on the comments and findings in Section 5 and 6 of the project <br />report dated April 3, 2002. <br /> <br />Ayes: 5, Traynor, Duncan, Cunningham, Mulder, Wilke <br /> <br />Nays: 1, Olson <br /> <br />Motion: Member Mulder moved, seconded by Member Duncan, to recommend approval of a conditional use permit to <br />allow construction of a 32 foot by 28 foot (896 sq. ft.) detached accessory building in the rear yard of property located at <br />2415 Dale Street, based on the findings in Section 4 and the conditions stipulated in Section 7 of the project report dated <br />April 3, 2002 and with the stipulation that the existing garage will be razed and no additional buildings will be placed on <br />the site (besides the above mentioned 896 sq. ft. building). <br /> <br />Ayes: 5, Traynor, Duncan, Cunningham, Mulder, Wilke <br /> <br />Nays: 1, Olson <br /> <br />This matter will be heard at the City Council meeting of April 15, 2002. <br /> <br />8.
