<br />Mr. Paschke advised that Peter and Maureen Ohland were seeking approval of a preliminary plat which divides a <br />2.09 acre "R-1" zoned parcel of land into one single family lot and Outlot "A". Lot 1 is 0.53 acres (23,206 s.1.). <br />Outlot "A" is 1.56 acres (67,886 s.1.). Both lots meet the city subdivision and zoning requirements. The land is <br />currently owned by members of the extended Ohland Family (Dr. Robert and Lorraine Smith). <br /> <br />Mr. and Mrs. Ohland propose to construct a single family home on proposed Lot 1, which is 155' deep by 164' <br />wide. At 23,206 s.1., Lot 1 is over twice the size of the minimum required lot size. Outlot "A", with steep slopes to <br />the southeast, will remain undeveloped at this time. There is some vegetation along the Kent Street right-of-way, <br />most of which will remain in place at this time, but would have to be removed for road construction if the remainder <br />of the site was to develop. <br /> <br />The platting process requires right-of-way dedication along Kent Street, in the amount of 27'x 155' or 4,185 s.1. It <br />also requires the new lot to dedicate land or pay for park dedication. There is no park adjacent to this site - the City <br />prefers the cash dedication, to be taken up by the Park Commission in September. <br /> <br />Based on the information provided and the findings in Section 5 of this project report, the Community Development <br />Staff recommends approval of the preliminary plat by Peter and Maureen Ohland, subject to the following <br />conditions: <br /> <br />a. Provision of all necessary utility easements. <br />b. Dedication of 27 feet by 164 feet of right-of-way for Kent Street <br />c. Review and recommendation by the Parks and Recreation Commission regarding park dedication. (Staff <br />recommends cash dedication, which is $1,000 per dwelling unit.) <br />d. Meeting all requirements of Capitol Regions Watershed District. <br /> <br />Paul Inman, 520 West Ryan, owns the land to the east. He asked how sewer and water would serve the Outlot. <br /> <br />Maureen Ohland, applicant, proposes a walk out rambler that can accommodate parents as well. No other <br />development is proposed. <br /> <br />Chairman Mulder closed the hearing. <br /> <br />Motion: Member Bakeman moved, second by Member Peper, to recommend <br />Approval of the request by Peter and Maureen Ohland for a Preliminary Plat of certain property located at <br />544 Ryan Street subject to the conditions outlined in Section 6 (a through d) of the project report dated <br />August 6, 2003. <br /> <br />Ayes: 5 <br />Nays: 0 <br />Motion carried. <br /> <br />g. Planning File 3507: Request by Vicorp Restaurants, Inc., for consideration of a variance to Section <br />1 005.01A2 (Side Yard Setback) of the Roseville City Code to allow a restroom addition onto the east side of <br />the Baker's Square restaurant, 1881 Highway 36 Service Drive. <br /> <br />Chairman Jim Mulder opened the hearing and requested Intern City Planner Nathan Bouvet to provide summary of <br />the staff written report dated August 6, 2003. <br /> <br />Nathan Bouvet, Planning Intern, indicted Vicorp Restaurant Inc. (Rick Foerster) was requesting a 5 foot two inch <br />variance to Section 1 005.01A2 (Side Yard Setback) to allow construction of a 5 foot by 15 foot (75 sq. ft.) uni-sex <br />restroom at 1881 Highway 36 West in accordance with Minnesota State Accessibility Code. <br /> <br />Mr. Bouvet advised that based on the information provided and the findings in Section 5 of the project report dated <br />August 6, 2003, staff recommends approval of a five foot two inch variance to Section 1005.01 A2 of the Roseville <br />City Code to allow construction of a uni-sex restroom at 1881 Highway 36 West, subject to the following conditions: <br /> <br />a. The uni-sex restroom being setback a minimum of four feet ten inches from the adjacent eastern property line. <br />b. The review and approval of a building permit consistent with the approved plans and variance. The new building <br />to match the existing building in color and/or materials. <br />c. The uni-sex restroom both meet and comply with the Minnesota State Accessibility Code <br /> <br />Dave Ryan, Manager, explained setbacks from the existing restrooms and adjacent dumpster area. <br /> <br />Chair Mulder asked for clarification of existing overhangs and new roof lines. <br /> <br />Chair Mulder closed the hearing. <br />
