The Contractor shall be liable for penalty amount(s) upon determination of the City of Roseville that performance has not occurred consistent with the provisions of the contract. The City may deduct the full amount of any penalties from any payment due to the Contractor. The remedy available to the City under this paragraph shall be in addition to all other remedies which the City may have under law or at equity. Exceptions: For the purposes of this Proposal, the Contractor shall not be deemed to be liable for penalties where its inability to perform recycling collection service is the result of conditions beyond the control of the Contractor, including but not limited to civil disorder, acts of God, inclement weather severe enough that trucks cannot safely take collections, provided however, that the Contractor shall obtain the approval for the delay from the Recycling Coordinator or their designee prior to 4:00 p.m. of the scheduled Collection Day. 23. Insurance Contractor shall provide a Certificate of Insurance as proof of general liability coverage for bodily injury or death in the amount of $1 million for bodily injury or death and in the amount of$200,000 for damages to property. The Contractor shall also provide a Certificate of Vehicle Liability Insurance in the amount of at least $1,000,000. The Certificate ofInsurance shall name the City as an additional insured, and state that the Contractor's coverage shall be the primary coverage in the event of a loss. Further, the Certificate shall provide for thirty-(30) days' written notice to the City before cancellation, expiration, or change of coverage. 24. Workers Compensation The Contractor shall provide evidence of Workers Compensation insurance covering all employees of the Contractor engaged in the performance of the Contract, in accordance with the Minnesota Workers Compensation Law. 25.
