Wine Time as it exists <br />today would be downsized to just a wine store occupying a portion of the northwest corner of the <br />building (a current location) and Dunn Bros would occupy the vacated street side space. <br /> <br />The City Code identifies this type of use (café) as a Class II Restaurant or Fast Food Convenience, <br />requiring a Conditional Use Permit for the drive-through portion of the use. <br /> <br />Based on the findings outlined in Section 6 of this report, staff recommended approval of the request <br />for a conditional use permit to allow the construction and operation of a new drive-through facility at <br />Starbuck’s 2305 Fairview Avenue North, subject to the following conditions: <br /> <br />a.Submittal of a revised site, lighting, and landscape plan including the three curbed islands <br />similar to the plan designed by Staff (05/07/03); the design of angle parking in the south <br />parking lot; parking and building lighting meeting Section 1010.12 of the City Code; additional <br />plantings along the west and south property line, including trees consistent with the City’s <br />Street Tree Master Plan. <br /> <br />b.Minor variations from the approved plans may be approved by the City’s Development <br />Review Committee, under the direction of the Community Development Director; however, <br />any substantial departures from the approved plans will require an amendment to the <br />conditional use permit. <br /> <br />c.All signage, including the menu board, for the project must comply with the requirements of <br />Section 1009 of the City Code, including the size and location of wall signs, monument sign, <br />and directional signs. <br /> <br />d.The curb along the front of the property shall be repaired and/or replaced. Paving must be <br />repaired by mill and overlay or other technique approved by the Public Works Director, <br />especially the drive-thru lane which must be upgraded to withstand higher traffic volumes and <br />increased vehicle weight. Pedestrian access from and through the parking lot must be clearly <br />marked at the entry point by painting the pavement surface and caution signage near the <br />front door of the building. The drive lane into and through the site must be a one way drive. <br />Parking stalls on the south side of the parking lot must be angled and curb and/or striped <br />island be placed where appropriate to properly direct/prohibit traffic. <br /> <br />e.Prior to a building permit being issued for redevelopment of the site, the applicant shall post a <br />landscape bond, letter of credit, or other security acceptable to the City, in an amount equal <br />to 150% of the cost of landscaping, trash enclosures, and site paving and curbing restoration. <br />The specific amount of this security shall be determined by the Community Development <br />Director following completion of all site construction plans. <br /> <br />f.The applicant shall record the approved conditional use permit with the Ramsey County <br />Recorder prior to the issuance of any building permit or within sixty days of approval, <br />whichever is less (Section 1013.01-City Code). <br /> <br />g.The conditional use permit shall expire within six months of the date of City Council approval <br />if a building permit is not obtained for the approved development (Section 1013.03 of the City <br />Code). <br /> <br />h.Minor variations from the approved plans may be approved by the City’s Development <br />Review Committee, under the direction of the Community Development Director; however, <br />any substantial departures from the approved plans will require an amendment to the <br />conditional use permit. <br /> <br />Member Bakeman asked if the Wine Store door would open directly into the driveway lane – (yes) <br />and how it must be protected for pedestrian safety. Steve Chinander, Owner of Love from <br />Minnesota, illustrated the two entry points along the north wall, and the traffic flow from the drive <br />through window. Charles Schatz, DJR Architects (for Dunn Bros.) said there is plenty of room for the <br />north wall raised sidewalk and\or protective curb.
