He asked if there are other 1,008 s.f. <br />garages (yes, by CUP). <br />Chair Traynor explained the difference between a CUP and a variance request, the CUP is a use <br />presumed to be permitted, usually with conditions. <br />Member Boerigter asked if the attached garage should have a permit, and should this be a condition of <br />the CUP? Thomas Paschke said it should have a building permit required before the new detached <br />garage gets a final Certificate of Occupancy, otherwise a variance would be requires for the attached <br />garage and the existing shed). <br />The City Planner had recommend approval of a CONDITIONAL USE PERMIT for Terrance Fenne to <br />allow the construction of a 1,008 sq. ft. detached accessory structure, based on the findings in Sections 6 <br />of the staff report and the following conditions: <br />a.The total impervious coverage on the parcel after construction of the 1,008 sq. ft. detached <br />accessory structure (garage) and driveway improvement and existing house improvements shall <br />not exceed 5,489 sq. ft or 30% of the overall 18,295 s.f. lot size. <br />b.The detached accessory structure (garage) shall be set back a minimum of 5 feet from the interior <br />side yard (east/west) property line and a minimum of 5 feet from the rear yard (south) property line. <br />c.No other detached accessory structure or garden shed shall be permitted on the parcel. The <br />existing shed located in the rear yard (south) must be removed from the premises. <br />d.The size of the detached accessory structure shall not exceed 1,008 sq. ft.; its height shall not <br />exceed an exterior wall height of 9 feet and an overall height of 15 feet to the mid-point of the roof <br />truss (measured from grade). <br />e.The exterior color, design, and/or material of the detached accessory structure shall be similar to <br />the principal structure (Section 1004.01A12). <br />f.Drainage and roof gutters shall be installed to direct runoff away from the adjoining <br />(south/east/west) property. <br />g.The CONDITIONAL USE PERMIT shall expire within six months after the approval date (May 21, <br />2006) unless that applicant has been granted a building permit. <br />There being further public comment, Chair Traynor closed the public hearing. <br />Motion: Member Bakeman moved, second by Member Boerigter to recommend approval of a <br />conditional use permit for Terrance Fenne, 910 Highway 36, to allow the construction of a 1,008 <br />sq. ft. detached accessory building in the rear yard, based on the findings in Section 6 and the <br />conditions of Section 7 of the project report dated November 2, 2005, and added the additional <br />condition: a building permit is required and must be issued to convert the attached garage to <br />living area prior to the Certificate of Occupancy for the new detached garage. <br />Member Bakeman stated that the 11 foot setback (an addition of 6 feet over what the Code normally <br />requires) and conditions to convert the attached garage to housing were important conditions to this <br />approval. Chair Traynor agreed and noted that this project is consistent with the Comprehensive Plan and <br />encourages investment in the neighborhood, and the narrow side (lesser visual impact) of this structure <br />faces the neighbors. <br />Ayes: 7 <br />Nays: 0 <br />Motion carried: 7-0 <br />3 of 53/13/2006 8:48 AM <br /> <br />
