For the <br />drive lane, fire trucks do not need directional requirements. <br />Member Wozniak asked if there are requirements for protective barriers adjacent to the play area. (State <br />licenses could require this on the site plan review. There is no specific requirement in the City Code.) <br />Member White explained that the fence should be more than 4 feet in height, usually 6 feet. Member <br />Boerigter added that Mini-Apple Center on Perimeter Drive has a 4 foot fence. <br />Carol Arens, day care provider, explained that the play ground fence would be 8 to 10 feet in height. The <br />drive lane will be retained. State rules require an enclosure but not a barrier. <br />Member Wozniak asked for details of the playground surface. (Jack & <br />Lincoln Drive based on the findings of Section 5 and conditions of Section 6 of the project report <br />dated February 1, 2006. <br />Ayes: 6 <br />Nays: 0 <br />Motion carried: 6-0 <br />d.Planning File 3709: Big City Tavern & Oops Theater, 2784 Lincoln Drive, request for <br />existing lower level banquet area. <br />Chair Traynor opened the hearing and requested City Planner Thomas Paschke to provide a verbal <br />summary of the proposed project based on the staff report dated February 1, 2006 City Planner Paschke <br />explained that Big City Tavern & Oops Theater have requested a conditional use permit (CUP) to allow a <br />dinner theater to utilize a portion of the existing lower level banquet area. Section 1005.015 of the <br />section of the Code. <br />Because the site had limited parking (172 spaces) the owner was required to enter into agreements with <br />adjacent/adjoining properties for sharing off-peak hour parking. This strict requirement was necessary to <br />ensure that adequate (Code required) parking was achieved given the multiple uses that could occur at <br />any one time. However, since the issuance of that permit, the owners have terminated their agreement <br />with Clear Channel Communication and have changed the name of the restaurant and auxiliary uses to <br />Big City Tavern & Banquet Center. The business also does not have the traffic originally anticipated by <br />staff when first reviewed. <br />The original structure was built in 1986, is located on 2.4 acres, has a Comprehensive Land Use Plan <br />designation of Business, is located in Planning District 10, and the property is zoned B-2, Retail Business <br />6 of 94/3/2006 11:54 AM <br /> <br />
