City of Roseville - Variance Board Minutes for September 1, 2004Page 3 of 4 <br />Member Doherty asked if there was any reasonable place on the site for a sign (no). All others <br />would require variances. Member Doherty asked the differences between Brentwood (37’) and the <br />Kinderberry sign (41’), further from the right-of-way. <br />No comments were received from the audience. Chair Bakeman closed the hearing. <br />Motion: Member Doherty moved, seconded by Member Boerigter, to adopt a Resolution <br />approving a ten (10) foot Variance to Section 1009.03M, of the Roseville City Code for Rose of <br />Sharon, Inc. (Kinderberry Hill Child Care), 1360 Lexington Avenue, based on the findings in <br />Section 5 of the project report dated September 1, 2004, and contingent upon the applicant’s <br />compliance with the conditions of Section 6 of the project report dated September 1, 2004. <br />Ayes: 3 <br />Nays: 0 <br />Motion carried: 3-0 <br />c.Planning File 3597: Request by Frank Konstantinides, 1911 Dellwood Avenue, for a two foot <br />Variance to Section 1012.02B3 of the Roseville City Code to allow the installation of an 8 ½ <br />foot tall fence in the corner side yard adjacent to Roselawn Avenue. <br />Chair Bakeman opened the hearing and requested City Planner Thomas Paschke provide a verbal <br />summary of the project report dated 9/01/04. <br />Thomas Paschke advised that Mr. Konstantinides has submitted a proposal to replace a 5 foot tall <br />fence with an 8-1/2 foot tall fence in his corner side yard adjacent to Roselawn Avenue to provide <br />his family with privacy and reduce the noise generated from Roselawn Avenue. Section 1012.02B3 <br />(Required Yards & Open Space – Side or Rear Yard Only) requires fences not to exceed 6-1/2 feet <br />in height. <br />Mr. Konstantinides owns the lot located in the southwest corner of Dellwood Avenue and Roselawn <br />Avenue, which is a corner lot with Dellwood Street acting as the front yard and Roselawn Avenue <br />acting as the side yard adjacent a public street. <br />The Staff recommended approval of a 1-1/2 foot Variance to Section 1012.02B3 of the Roseville <br />City Code for Frank Konstantinides, 1911 Dellwood Avenue, based on the findings of uniqueness <br />(slope and visibility) in Section 5 and the following conditions as outlined in the project report dated <br />September 1, 2004: <br />a.The fence not exceeding a height of 8 feet measured from the existing grade to top of fence. <br />b.The 8 foot fence height only being allowed along the north property line (adjacent to <br />Roselawn Avenue from the west property line to a point 5 feet from the driveway edge. <br />Member Boerigter asked the applicant to explain the height difference between the street grade and <br />the lot (2 to 21/2 feet). <br />Mr. Konstantinides, 1911 Dellwood Avenue, explained the shed will be moved south five feet. The <br />shed may be taken down and rebuilt. The fence could be placed to within one or two feet of the west <br />side of the driveway. <br />Member Doherty asked if 8 feet (staff) recommendation was adequate or should the Variance <br />Committee consider 8 1/2 feet (the applicant prefers an 8 ½ foot fence). <br />Chair Bakeman asked if the curb and gutter will be installed when Roselawn is returned to a City <br />street (no answer at this time).
