Member Shiely asked if the city has a written policy. Schwartz said no. <br />Member Shiely said there should be one. He went on to say that <br />employees should give emergency assistance to residents, such as if a tree <br />was blocking their entrance. Chair Wilke said that Police, Fire and Public <br />Works already coordinate services during emergency situations so that’s <br />not an issue. Member Shiely said that the liability and duress questions <br />should be addressed by the city attorney. Chair Wilke asked him to <br />explain. He said employees shouldn’t have to worry about being sued if <br />they are just doing their job and helping someone. Member Willenbring <br />said he thought there was a state law prohibiting that from happening. <br />Schwartz said he thought that covered injury to an individual not damage <br />to property. <br /> <br /> Member Fischer said that the crews have enough of a job to do with <br />clearing streets of trees and debris, and he would feel uncomfortable with <br />them having to make decisions on whether or not to help individual <br />residents. <br /> <br /> Member Willenbring said he thought they were getting carried away and <br />too deep into the subject. Chair Wilke agreed and said they should keep <br />the discussion on the policy question that Mr. Schwartz had brought to the <br />table. <br /> <br /> Chair Wilke said he’s comfortable with the 25% policy that is currently <br />being used and maybe it should be in writing to make it more official. <br />Schwartz said he agreed that it would give the department more <br />credibility. He clarified that the 25% was not the amount of trees but the <br />area that had damage. <br /> <br /> <br />7.Commission Rules of Procedure (Continuation) <br /> <br /> Member Shiely asked if the meeting time could be changed to 6:30 p.m. <br />instead of 7:00 p.m. <br /> <br /> The draft version of operating procedures were read aloud by Member <br />Willenbring. <br /> <br /> Member Shiely moved to adopt the operating procedures as presented, <br />with the exception of changing the meeting time to 6:30 p.m. Schwartz <br />suggested they add April as the month to elect the chair and vice-chair <br />since that would be the first meeting for newly-appointed members.
