<br />WHEREAS, it is desirable that the position of the Village be made <br />clear, and certain delinquent accounts be collected; and <br /> <br />WHEREAS, the sum of Two Thousand, Five Hundred Dollars ($2,500. 00) is <br />presently being withheld for the Company's unpaid personal property taxes, <br />which has now been reduced to judgment in the Ramsey County District Court for <br />an amount in excess of Two Thousand, Five Hundred Dollars ($2,,500.00); and <br /> <br />WHEREAS, the Company claims said judgment now entered in the <br />Ramsey County District Court is void, <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL FOR <br />THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />1. The Village Council agrees to obligate the Village to pay <br />those delinquent accounts shown in Exhibit A attached hereto and hereby made <br />a part hereof. <br /> <br />2. The Village Manager is hereby directed to add the amounts <br />shown in Exhibit A to the regular water bills for each premises affected. <br /> <br />3. The Village Council acknowledges the delinquent account <br />of Gino D'Amalfi, formerly of 2720 North Oxford Street. The Village Manager <br />is hereby directed to deduct said amount from an outstanding statement for <br />services rendered to the Village for certain accounting services by Gino D'Amalfi, <br />and the Manager is then directed to pay the balance then due and owing to Gino <br />D'Amalfi. <br /> <br />4. The Village Council hereby determines that it does not <br />have sufficient information to form an opinion as to its obligations relative <br />to those accounts shown on Exhibit B attached hereto and hereby made a part <br />hereof. The Company is hereby notified that said accounts will be accepted <br />by the Village upon receipt by the Village of a statement signed by each obligee, <br />stating the amount owed the Company by the obligee, the dates during which <br />said obligation arose, and an assignment of each such account by the Company <br />to the Village. <br /> <br />5. The Company is hereby notified by the Village that the <br />Village Council denies that the amount shown by the August 9, 1965 demand <br />relative to Neal King for $810.00 for connection charges and $17.20 for water <br />bills are obligations of the Village, and will not make a payment under any <br />circumstances for such account. <br /> <br />-2- <br />
