<br />to allow engineers to study their performance and make determinations <br />as to the feasibility of the use of such poles at angles of the trans- <br />mission line, and <br /> <br />WHEREAS, it is the intention of the Village Council of <br />the Village of Roseville to allow five towers only in the residential <br />areas of the Village of Roseville, which five towers are generally <br />at angles of the transmission line, and it is the intention of the <br />Village Council to require that these towers be removed at a time <br />when there is sufficient engineering data available for the performance <br />of single poles at angles on transmission lines, and <br /> <br />WHEREAS, one tower proposed to be constructed by NSP <br />will occupy a portion of a Village street, said tower being Tower No. <br />103, it is the intention of the Village Council by adopting this <br />Resolution that this Resolution will constitute a permanent public <br />right of way use permit for the construction of Tower No. 103, as <br />shown in Exhibit 1 attached hereto, and <br /> <br />WHEREAS, the Village of Roseville claim s that Section <br />32.020 of the Village Code is applicable in determining the amount <br />of a building permit fee required by NSP, and <br /> <br />WHEREAS, NSP denies that it is obligated to pay a building <br />permit fee, it is the intention of the Village Council to establish a <br />compromise building permit fee in the amount of Two Thousand Dollars <br />($2,000.00), and no electrical inspection fees. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />OF THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />1. <br /> <br />The application as submitted by NSP is hereby <br /> <br />denied. <br /> <br />2. A Special Use Permit and Variance on the following <br />term s and conditions is hereby granted: <br /> <br />(a) NSP is hereby granted a Special Use Permit <br />to construct a 345 kv double circuit transmission line in <br />the Village of Roseville along the route shown in red on <br />the attached drawing marked Exhibit 1. The supporting <br />structure for that portion of the transmission line between <br />Rice Street and Fairview Avenue shall consist of single <br />steel poles with the exception of five frame towers. The <br />location of the five frame towers are shown as Towers <br />No. 75, 76, 82, 83 and 84, and may be constructed <br />as originally designed and as shown on the drawing <br /> <br />-z- <br />
