Regular City Council Meeting <br />Monday, June 18, 2007 <br />Page 39 <br />Staff recommended DENIAL of the request of Mr. DeLeo to use his <br />RV, or his garage, as temporary living quarters during the construc- <br />tion of his new home, based on the comments and findings of Section <br />5 of the project report dated June 18, 2007; noting that the Planning <br />Commission, at their June 6, 2007 meeting, voted unanimously (6/0) <br />to recommend approval. <br />Discussion included staff-defined difficulties with the previous ap- <br />proval for Mr. Anderson; construction delays and burdens on the <br />neighbors, additional staff time to monitor the temporary living situa- <br />tion, and possible safety concerns if construction delays require living <br />in the temporary facility into the fall and winter months. Staff noted <br />that the temporary facility didn't meet safety and/or code standards, <br />but admitted that enforcement was problematic. <br />Applicant, Robert DeLeo, 280 Minnesota Avenue <br />Mr. DeLeo responded affirmatively to Mayor Klausing's questions if <br />the Fire Marshal's references were addressed and that fire safety <br />equipment was immediately available in the recreational vehicle. <br />Public Comment <br />Darlene Quade, next door neighbor <br />Ms. Quade spoke in support of the request; and offered her home to <br />the DeLeo's in case of storm. Ms. Quade noted that this was only a <br />temporary situation, and was prudent to avoid vandalism or theft is- <br />sues on the construction site as well. <br />Ihlan moved, Kough seconded, approval of Robert DeLeo's request <br />for an INTERIM USE PERMIT (IUP) to use his recreational vehicle <br />(RV) as temporary living quarters during the construction of his new <br />home, based on the comments and findings of Section 6.0 of the staff <br />report dated June 18, 2007; and amended to include the following <br />conditions: <br />^ The permit will extend only to the end of October 2007, at <br />which time the applicant will vacate the temporary living quar- <br />ters in the RV; <br />^ The garage is excluded from use as temporary or permanent liv- <br />ing quarters; <br />
