City Council Study Sessio
Monday, July 16, 2007
Page 2
(Pipe & Cigar Store Proprietor)
Mr. Beahrs spoke to the Police Department's semi-annual tobacco
compliance checks. Mr. Beahrs questioned the intent of the spirit of
the law and the entrapment process used in the sting operations using
undercover artificial stimulations. Mr. Beahrs noted that he was sup-
portive of unannounced inspections and/or observation by uniformed
or undercover police officers; and requested the City Council recon-
sider their current program. Mr. Beahrs opined that the current pro-
gram has become highly politically trendy, and proprietors needed to
be treated with respect and not presumed criminals subject to harass-
ment.
Councilmember Kough questioned if Mr. Beahrs participated in com-
pliance training for himself anal his staff. Councilmember Kough ad-
vised that it ,vas the Council's intent that no sales of tobacco or alco-
hol products were made to minors.
Mr. Beahrs responded affirmatively that they did participate in train-
ing; and assured the City Council that if they observe suspicious activ-
ity outside or inside their store, they refuse them service. Mr. Beahrs
advised that his store didn't sell cigarettes or chewing tobacco at all.
b. Steve Burwell, 2482 N Albert, Proprietor of Fairview Wine &
Spirits
Mr. Burwell noted that he and his family had been in business for over
twenty-two (22) years, and had been before the City Council numer-
ous times to defend the industry. Mr. Burwell acknowledged that last
Wednesday afternoon, the Roseville Police Department conducted its
first of two annual compliance checks and he had been on duty, and
he didn't card the individual. Mr. Burwell offered his profuse apolo-
gies to the City Council, made no excuses for not having followed
procedure, and assured the Council that he was "eating crow," and
would make every effort in the future that this wouldn't happen again.
Mayor Klausing thanked Mr. Burwell for his comments, and assured
Mr. Burwell that he was confident of his integrity and diligence.
c. Randy Neprash, 1276 Eldridge Avenue
