Regular City C®uneil eating <br />1VI®nd ay, July 23, 2007 <br />Page 12 <br />ity to proceed on such a controversial issue, without Council consen- <br />sus; and further opined that this was due to a lack of leadership. <br />Councilmember Pust, in response to Councilmember Ihlan's indica- <br />tion that the City was contractually bound for Quick Take Eminent <br />Domain proceedings, suggested that members of the public personally <br />review contract language, Section 3.2, and the City's legally binding <br />obligations. Councilmember Pust opined that the City Council could <br />have breached the contract at that point; however, the Council maj or- <br />ity determined that it was prudent to comply with the terms of the <br />contract. Councilmember Pust defended her vote to proceed with <br />Quick Take Eminent Domain actions; and noted that no one was forc- <br />ing the City to make this settlement; and opined that each Council- <br />member needed to make their own decisions on what they personally <br />thought was in the best interest of the City, with taxpayers having the <br />right to hold each Councilmember accountable. <br />Mayor Klausing opined that the settlement agreement seemed to fol- <br />low the Twin Lakes project itself, and compared idealized goals pre- <br />ferred to be realized and realities now before the City Council. Mayor <br />Klausing further opined that each Councilmember was doing what <br />was best in their opinion, unfortunately, situations often degenerated <br />into personal politics. Mayor Klausing further opined that, while each <br />Councilmember may reach a different conclusion in their own way, it <br />was his intent to vote in support of the proposed settlement agreement <br />as presented. <br />Councilmember Ihlan encouraged the City Council to consider hiring <br />independent counsel before taking action on the settlement agreement, <br />to allow pursuit of other options. <br />Councilmember Pust opined that such consideration would be moot <br />point at this time, and spoke in opposition to such a motion, noting <br />that the, noting the timeframe provided in Item # 1 of the terms of the <br />settlement offer. <br />Mayor Klausing spoke in opposition to pursuing independent counsel; <br />noting that there was a history of allegations of "tainted" legal coun- <br />
