Roe moved, Pust seconded, adoption of Resolution No. 10538 enti- tled, "A Resolution Approving an Interim Use Permit in Accordance with Roseville City Code, Section 1012.09 for Mark Theobald and ERP Minnesota Portfolio, LLC, 2581 Fairview Avenue (PF07-042)." Roll Call Ayes: Ihlan; Pust; Kough; Roe; and Klausing. Nays: None. 8. Consider Items Removed from Consent a. Resolution - Adopt a Resolution Extending the Working Hours for AMC Rosedale Center 14 Theatre Entry Plaza Vestibule Ad- dition (Former Consent Item 7.i) Mayor Klausing opened Public Hearing to consider this request at 6:50 p.m. City Engineer Debra Bloom briefly reviewed the request; noting that the applicant would like to initiate work on Tuesday, August 14, 2007, to accommodate additional hours when the mall was not operational, and in an attempt to finish before the upcoming holiday shopping sea- sons. Ms. Bloom also noted the applicant's desire to create less inter- ference with bus and vehicular traffic within the immediate site, ad- dress safety issues, and avoid disruptions during popular movie atten- dance times. Ms. Bloom advised that staff had provided published and mailed no- tice to property owners within five hundred feet (500'), and had re- ceived no comment. Ms. Bloom advised that there may be someone at tonight's meeting wishing to comment. Staff recommended ap- proval of the requested hour variance. Discussion included weekday versus weekend extended hour requests; original design flaws; and a recourse for any residents in adjacent apartments if noise issues become problematic.
