City Engineer Bloom expressed confidence that, should any problems arise, the City's existing nuisance code provisions would provide suf- ficient recourse. Mayor Klausing closed the Public Hearing at 6:58 p.m., with no one appearing for or against. Kough moved, Pust seconded, adoption of Resolution No. 10539 enti- tled, "Resolution Extending Working Hours for AMC Rosedale Cen- ter 14 Theatre Entry Plaza Vestibule Addition;" extending working hours from August 14 - 31, 2007 during nighttime hours of 1:00 a.m. to 7:00 a.m.; and from September 1 -November 30, 2007 during early morning hours from 6:00 am. To 7:00 a.m. Roll Call Ayes: Ihlan; Pust; Kough; Roe; and Klausing. Nays: None. b. Property Acquisition of 1779 Rose Place City Attorney Anderson advised that the Open Meeting law required the City, prior to closing a meeting, to state the grounds allowing clo- sure and to describe the subject to be discussed. Mr. Anderson ad- vised that, according to Minnesota Statute, Section 13.D OS subd. 3 (c) (3) of the Open Meeting Law, closure was permitted for property acquisition discussions and negotiations; which had taken place re- garding property at 1779 Rose Place. Mr. Anderson noted that Mayor Klausing had opened the meeting in Open Session at approximately 5:45 p.m. in the Aspen Room with Council concurring on a vote of 4-0 (Pust absent). Then the meeting relocated to the City Council Chambers due to audio difficulties in the Aspen Room at which time Councilmember Pust arrived at 5:47 p.m. Mr. Anderson further noted that the meeting was closed and the Coun- cil convened in Executive Session; with Mayor Klausing adjourning the meeting at approximately 6:05 p.m.
