Regular City Council Meeting <br />Monday, August 13, 2007 <br />Page 13 <br />City Attorney Anderson clarified that this variance request was not a <br />land use variance request. <br />City Engineer Bloom expressed confidence that, should any problems <br />arise, the City's existing nuisance code provisions would provide suf- <br />ficient recourse. <br />Mayor Klausing closed the Public Hearing at 6:58 p.m., with no one <br />appearing for or against. <br />Kough moved, Pust seconded, adoption of Resolution No. 10539 enti- <br />tled, "Resolution Extending Working Hours for AMC Rosedale Cen- <br />ter 14 Theatre Entry Plaza Vestibule Addition;" extending working <br />hours from August 14 - 31, 2007 during nighttime hours of 1:00 a.m. <br />to 7:00 a.m.; and from September 1 -November 30, 2007 during <br />early morning hours from 6:00 am. To 7:00 a.m. <br />Roll Call <br />Ayes: Ihlan; Pust; Kough; Roe; and Klausing. <br />Nays: None. <br />b. Property Acquisition of 1779 Rose Place <br />City Attorney Anderson advised that the Open Meeting law required <br />the City, prior to closing a meeting, to state the grounds allowing clo- <br />sure and to describe the subject to be discussed. Mr. Anderson ad- <br />vised that, according to Minnesota Statute, Section 13.D OS subd. 3 <br />(c) (3) of the Open Meeting Law, closure was permitted for property <br />acquisition discussions and negotiations; which had taken place re- <br />garding property at 1779 Rose Place. <br />Mr. Anderson noted that Mayor Klausing had opened the meeting in <br />Open Session at approximately 5:45 p.m. in the Aspen Room with <br />Council concurring on a vote of 4-0 (Pust absent). Then the meeting <br />relocated to the City Council Chambers due to audio difficulties in the <br />Aspen Room at which time Councilmember Pust arrived at 5:47 p.m. <br />Mr. Anderson further noted that the meeting was closed and the Coun- <br />cil convened in Executive Session; with Mayor Klausing adjourning <br />the meeting at approximately 6:05 p.m. <br />
