Regular City Council Meeting <br />Monday, August 13, 2007 <br />Page 18 <br />City Attorney Anderson advised that following tonight's Council ac- <br />tion, the City Attorney office would provide each applicant with writ- <br />ten, detailed Council action, and notice of their rights of appeal and <br />process. <br />Pust moved, Roe seconded, authorizing the Roseville Police Depart- <br />ment to issue and administer the presumptive penalty as set forth in <br />Section 302.15 for on-sale license holders who do not participate in <br />optional manager and server training for a first violation, with the <br />mandatory minimum penalty being a $500.00 fine and cone-day sus- <br />pension; with the date for license suspension at the discretion of the <br />Police Chief. <br />Roll Call <br />Ayes: Ihlan; Pust; Kough; Roe; and Klausing. <br />Nays: None. <br />Davanni's <br />Chief Sletner outlined the specifics of this compliance failure and <br />staff s recommendation. <br />No one from Davanni's was present to speak. <br />An e-mail was referenced and read by Councilmember Roe, that had <br />been received earlier that afternoon from Davanni's manager, Rox- <br />anne Zeherr, and their actions immediately following compliance fail- <br />ure; as well as their request that their establishments no longer sell al- <br />cohol. <br />Roe moved, Ihlan seconded, authorizing the Roseville Police Depart- <br />ment to issue and administer the presumptive penalty as set forth in <br />Section 302.15 for on-sale license holders who do participate in op- <br />tional manager and server training for a second violation in thirty-six <br />(36) months, with the mandatory minimum penalty being a $500.00 <br />fine and aone-day suspension; with the date for license suspension at <br />the discretion of the Police Chief. <br />Roll Call <br />Ayes: Ihlan; Pust; Kough; Roe; and Klausing. <br />
