Regular City Council Meeting <br />Monday, August 13, 2007 <br />Page 25 <br />Al Sands, 2612 Aldine <br />Mr. Sands opined that there was a conflict between the requested ac- <br />tion from staff and the City Attorney's written legal opinion (Attach- <br />ment B) related to process and timing of public comment and declar- <br />ing the document complete and accurate. <br />Mr. Sands provided a bench handout, and a history of recent a-mails <br />between him and Councilmember Roe, and requested that they be <br />made part of the record. Mr. Sands disputed City Council action and <br />minutes from the June 26, 2001 meeting, Master Plan scenario 1; and <br />alleged that the additional options were not necessary to amend the <br />Comprehensive Plan and further alleged that the AUAR Update was a <br />fraudulent document. Mr. Sands provided personal comments on <br />"Mayor Klausing's Grand Plan" for moving the Twin Lakes LLC de- <br />velopment forward and past flawed legal opinion for the number of <br />votes required for approval. <br />Discussion included clarification and interpretation on the meaning of <br />the City Attorney's legal opinion for the AUAR process and public <br />comment. <br />Councilmember Ihlan opined that the City Attorney's letter indicated <br />that public comment be held before declaring the document accurate <br />and complete and before distribution, and incorporated those com- <br />ments into the draft for the commenting agencies, and served as a <br />more efficient process. <br />Councilmember Roe questioned the process, declaring the document <br />accurate and complete, and holding distribution until after public <br />comment. <br />City Attorney Anderson advised that his and City Attorney Jay <br />Squires' analyses concluded that the City Council could approve the <br />document tonight, and withhold distribution until after the August 20th <br />meeting. However, Mr. Anderson noted other alternatives set forth in <br />their written opinion, in the context of tonight's requested action, and <br />public comment on August 20, 2007. <br />
