Citizen Petition -City Response to Citizen Petition for an Envi- <br />ronmental Assessment Worksheet on Oak Acres <br />Interim Community Development Director for the City of Roseville, <br />Mike Darrow, presented staffls recommendation for the citizen peti- <br />tion received by the EQB on the proposed Art Mueller subdivision, <br />calling for an EAW for "Oak Acres" proposed for 2201 Acorn Road. <br />Mr. Darrow provided the petition and EQB cover letter dated July 23, <br />2007, as a bench handout, noting that the EQB determined that the <br />City of Roseville was the appropriate governmental unit (RGU) to de- <br />termine the need for an EAW. <br />It was staff's analysis that the proposed four-lot publicly sewered <br />residential subdivision by Art Mueller was exempt from environ- <br />mental review; and that the subject property didn't lie within ashore- <br />land area, a delineated floodplain, state or federally designed wild and <br />scenic river district, the Minnesota River Project, or the Mississippi <br />headwaters area. Staff therefore recommended, in consultation with <br />the City Attorney, adoption of a resolution denying the citizen petition <br />for an EAW, based on analysis as outlined. <br />Extensive discussion ensued regarding staff's basis for determination <br />that no portion was in a shoreland area; definition of a shoreland dis- <br />trict or overlay district in the City of Roseville; applicable Minnesota <br />State Statue related to residential subdivisions and environmental re- <br />view; and the City Attorney's reliance on staff to review maps and <br />designations for that area related to flood plains and shorelands, and <br />consultations with the EQB, and their subsequent determinations. <br />Public Comment <br />Gary Boryczka, 2250 Acorn Road <br />
