Regular City Council Meeting <br />Monday, August 13, 2007 <br />Page 31 <br />Roe moved, Pust seconded, suspending Council Rules to extend the meeting cur- <br />few to complete discussion of this item, and Item 9.f entitled, "Discussion of Pro- <br />cedure for Filling Housing and Redevelopment Authority Vacancies." <br />Roll Call <br />Ayes: Ihlan; Pust; Kough; Roe; and Klausing. <br />Nays: None. <br />Councilmember Roe spoke in support of the motion; opining that it <br />was obvious the proposed development area was exempt. <br />Councilmember Pust addressed those in the audience and those listen- <br />ing at home, opining that whenever land is changed and development <br />happens, there were going to be environmental impacts. Council- <br />member Pust noted that the City and- state had many rules to minimize <br />those adverse impacts; however noted that the City Council only had <br />authority to require environmental review under certain criteria, and <br />opined that at the advice of the City Attorney and the EQB, the City <br />didn't have discretion to order an EAW in this instance. Council- <br />member Pust observed that simply saying we wished we had such au- <br />thority and trying to act accordingly, and the City Council making an <br />attempt to read ordinances based on whatever case appeared before <br />them, was not what they were elected to do. Councilmember Pust <br />spoke in support of the motion, based on current City Council author- <br />ity, even if she was in agreement with petitioners on the merits. <br />Roll Call <br />Ayes: Pust; Roe; and Klausing. <br />Nays: Ihlan and Kough. <br />Motion carried. <br />f. Discussion - Discuss a Procedure for Filling Housing & Redevel- <br />opment Authority Vacancies <br />Councilmember Roe presented a draft resolution, incorporating City <br />Attorney and Mayor Klausing review and comment, regarding the <br />HRA appointment process, in accordance with Minnesota Statute pro- <br />visions for mayoral appointment with approval of the governing body. <br />
