Roll Call Ayes: Ihlan; Pust; Kough; Roe; and Klausing. Nays: None. Councilmember Roe spoke in support of the motion; opining that it was obvious the proposed development area was exempt. Councilmember Pust addressed those in the audience and those listen- ing at home, opining that whenever land is changed and development happens, there were going to be environmental impacts. Council- member Pust noted that the City and- state had many rules to minimize those adverse impacts; however noted that the City Council only had authority to require environmental review under certain criteria, and opined that at the advice of the City Attorney and the EQB, the City didn't have discretion to order an EAW in this instance. Council- member Pust observed that simply saying we wished we had such au- thority and trying to act accordingly, and the City Council making an attempt to read ordinances based on whatever case appeared before them, was not what they were elected to do. Councilmember Pust spoke in support of the motion, based on current City Council author- ity, even if she was in agreement with petitioners on the merits. Roll Call Ayes: Pust; Roe; and Klausing. Nays: Ihlan and Kough. Motion carried. f. Discussion - Discuss a Procedure for Filling Housing & Redevel- opment Authority Vacancies Councilmember Roe presented a draft resolution, incorporating City Attorney and Mayor Klausing review and comment, regarding the HRA appointment process, in accordance with Minnesota Statute pro- visions for mayoral appointment with approval of the governing body.
