Planning Commission Meeting <br />Minutes – Wednesday, June 6, 2007 <br />Page 2 <br /> <br />Associate Planner Bryan Lloyd briefly reviewed the request of Mr. DeLeo requesting <br />an Interim Use Permit (IUP) to create temporary living quarters on the property until <br />occupancy of a new home is permitted. Mr. Lloyd noted that Mr. DeLeo owned the <br />property at 280 Minnesota Avenue, and had razed the former accessory structure and <br />replaced it with a new detached garage, with plans to build a new home in the same <br />general location as the former residence. <br /> <br />Mr. Lloyd noted that some neighbors were supportive of the use of the RV for living <br />quarters during construction; and others had expressed opposition, concerned with <br />the duration, and possible temporary relocation of the RV to the street to facilitate <br />construction. <br /> <br /> <br />Staff noted previous approval for Mr. Alexander, 920 Parker Avenue, with staff <br />reconsidering support of such temporary living quarters based on numerous <br />considerations. <br /> <br />DENIAL <br />Staff recommended of the request of Mr. DeLeo to use his RV, or his garage, <br />as temporary living quarters during the construction of his new home, based on the <br />comments and findings of Section 5 of the project report dated June 6, 2007. <br /> <br />Discussion among staff and Commissioners included, Interim Use Permit compatibility <br />and additional oversight requirements of staff and the Planning Commission in the use <br />of the property; proposed use not permitted under City Code, except through an <br />Interim Use Permit; staff rationale in not considering use of the newly-constructed <br />garage for temporary living quarters during the home’s construction (life safety and <br />fire code issues; sanitary sewer, water and electric utility connections and <br />functioning); setting of precedents in allowing temporary living space that deviates <br />from the spirit and intent of single-family use on single-family parcels; and function of <br />the RV in extreme temperature or storm situations and potential litigation risk for the <br />City in permitting living in such temporary facilities. <br /> <br />Additional discussion included the status of the demolition of the primary structure and <br />construction of the new structure; <br /> <br />Commissioner Wozniak expressed interest in additional information from staff in the <br />future related to the City’s requirements for hazardous materials prior to demolition. <br /> <br />The applicant, Robert DeLeo, 280 Minnesota Avenue <br />Mr. DeLeo thanked the Community Development Department for their assistance to- <br />date; clarified that the demolition permit was issues in late May, and the demolition <br />contractor, Bolander, had razed the structure after inspection for and removal of <br />hazardous materials. Mr. DeLeo expressed great satisfaction in the professional job <br />done by the contractor throughout the demolition process. <br /> <br />Mr. DeLeo advised that he was in possession of the building permit; had ninety (90) <br />truckloads of fill material brought onto the site to alleviate a drainage issue; noted that <br />footings had been poured earlier today; and anticipated basement walls to be poured <br />yet this week, with framing to begin soon. Mr. DeLeo further advised that he <br />anticipated that the house would be enclosed by the end of July, with construction <br />completed by October 15, 2007, at which time he would no longer need the temporary <br />housing space; also noting that the RV was scheduled to go into winter storage at <br />approximately that same time. <br /> <br /> <br />
