Regular City Council Meeting <br />Monday, September 24, 2007 <br />Minutes Page 16 <br />to the site, as well as her difficulty in referencing provisions of building mainte- <br />nance code, Section 906, unavailable on line. <br />Mayor Klausing apologized for any miscommunication on the part of the City; <br />however, opined that leaving the foundation in place would create a blight for <br />area businesses. <br />Ms. Hartley expressed her willingness to work with the City; however, asked that <br />a reasonable solution for leaving the foundation, rather than filling in the site, and <br />re-vegetating it, only to have that same material removed to accommodate rede- <br />velopment of the site within a short time frame. <br />Further discussion included the reason for Ms. Hartley's delay in responding to <br />staff s notice; determining who had received notice from staff; an admitted lack of <br />understanding on Ms. FIartley's part in code requirements; and Twin City Co-ops' <br />intent to begin construction in the Spring of 2008. <br />Staff confirmed that the applicant had applied for a demolition permit, but staff <br />had not issued it at this time, pending tonight's decision. <br />Ihlan moved to grant the appeal, directing staff to issue a Demolition Permit, with <br />the condition that construction be initiated within the time frame detailed under <br />the terms of the Conditional Use Permit in place; and if a Building Permit was not <br />issued within that time frame, the applicant remove the building foundation slab <br />and parking lot, and re-vegetate the site. There was no second to the motion at <br />this time. <br />City Attorney Anderson suggested revised language for a motion, and with further <br />discussion, Councilmember Ihlan withdrew her original motion, and restated it, <br />with Mr. Anderson's legal counsel. <br />Mayor Klausing opined his support for staff's recommendation to deny the ap- <br />peal; reiterating his concern for the blight for adjacent businesses. <br />Councilmember Pust noted the ongoing blight on area commercial businesses of <br />the vacant and damaged building versus demolishing the building and leaving the <br />foundation and parking lot intact for a few months. <br />Ihlan moved, Roe seconded, granting the appeal of Twin City Co-ops Federal <br />Credit Union to the administrative action of the Community Development De- <br />partment; conditioned upon demolition of the foundation/slab and parking lot to <br />occur in any event no later than the expiration of the Conditional Use Permit, or <br />any extension thereof. <br />
