Regular City Council Meeting <br />Monday, November 26, 2007 <br />Page 16 <br />Mr. Grefenberg opined that, by learning tonight of the Committee's advisory role, <br />the Committee was on track and needed to stay on issue. <br />b. Consider request by Emmes Realty Services LLC for an Amended Planned <br />Unit Development at HarMar Mall, 2100 Snelling Avenue N (PF07-053) <br />Mayor Klausing noted a bench handout from the applicant, requesting removal of <br />this item from tonight's agenda. <br />c. Consider request by Curtis Brown for a Minor Subdivision and Variances to <br />divide the existing parcel at 1754 Alta Visa Drive (PF07-062) <br />Associate Planner Bryan Lloyd provided brief review of request to eliminate non- <br />conforming status and create two (2) substandard residential parcels at 1754 Alta <br />Vista Drive. <br />Discussion included a map analysis of other substandard parcels in the area; pre- <br />vious approval for this parcel in 1986 for a Minor Subdivision and Variances to <br />City Code, but not recorded; and lack of an identified technical hardship. <br />Staff noted that they could provide no identified technical hardship; however, that <br />they supported recommendations of the Planning Commission to approve re- <br />quested variance and for Minor Subdivision approval to create two (2) new sub- <br />standard parcels as indicated, and based on Planning Commission findings. <br />Mayor Klausing noted that the applicant was present, and had provided written <br />comment included in Request for Council Action; but had no verbal comment to <br />add at this time. <br />When Mayor Klausing called for public comment, no one appeared to speak for <br />or against. <br />Ihlan moved DENIAL of requested variances to Roseville City Code; based on <br />granting variances only when undue hardships were evident; and there being no <br />legal basis for granting a variance for this request and the need to enforce mini- <br />mum lot size requirements. <br />The motion failed for lack of a second. <br />Roe moved, Klausing seconded, adoption of Resolution No. 10572 entitled, "A <br />Resolution Approving Variances to Roseville City Code, Section 1004 (Residen- <br />tial Districts) for Curtis Brown at 1754 Alta Vista Drive (PF07-060);" based on <br />the comments and findings of Sections 4 and 5, and the conditions of Section 6 of <br />the project report dated November 26, 2007. <br />Councilmember Ihlan spoke against the motion, opining that there was no undue <br />hardship to meet legal requirements; further opining that, as mentioned in the <br />
