Public Hearing and Consideration of 2008 Liquor License Renewals <br />Finance Director Chris Miller advised that sixty-five various type liquor licenses <br />were being considered for renewal. Mr. Miller noted that all were standard re- <br />newals, with the exception of On-Sale 3.2 Non-Intoxicating License for Da- <br />vanni's. Mr. Miller deferred to City Attorney Anderson to expand on the circum- <br />stances of this license renewal. <br />City Attorney Anderson advised that, due to past non-compliance during this <br />summer's compliance check process, the City Council had imposed a presumptive <br />penalty on Davanni's, which they did not appeal, for aone-day suspension. Mr. <br />Anderson noted, however, that alcohol had in fact been served on their day of <br />suspension of alcohol sales, to a compliance check officer; .and that staff and the <br />City Attorney's office were still sorting out analytically how to treat that viola- <br />tion. City Attorney Anderson opined that it would serve no purpose to withhold <br />renewal approval for other licensees due to this one license holder's non- <br />compliance and subsequent violation, and anticipated a determination and rec- <br />ommended ruling by the City Attorney for the December 17, 2007 City Council <br />meeting, for their consideration. <br />Mayor Klausing opened and closed the Public Hearing at 6:54 p.m., with no one <br />appearing to speak. <br />Roe moved, Klausing seconded, approval of the renewal of respective On-Sale <br />and Special Sunday Liquor Sales, On-Sale Club and Special Sunday Liquor Sales, <br />Wine, Off-Sale, On-Sale 3.2 Non-Intoxicating, and Off-Sale 3.2 Non-Intoxicating <br />Liquor Licenses for the calendar year 2008, as listed in detail in the Staff Report <br />dated November 26, 2007; subject to approval by the City's Police Chief; and fi- <br />nal review by the City Attorney. <br />Roll Call <br />Ayes: Roe: Pust; Kough; Ihlan; and Klausing. <br />Nays: None. <br />b. Hearing and Consideration of Delinquent Utility and Other Charges <br />Finance Director Chris Miller presented proposed assessments for annual certifi- <br />cation, in accordance with City Code, Sections 506, 801, and 802, for unpaid false <br />alarm, water, sewer, and other charges in excess of ninety (90)-days past due, for <br />collection on the following year's property taxes. A detailed list of properties via <br />property identification numbers (PIN'S) and addresses, as well as the specific type <br />and amount of unpaid bill(s) was provided as part of the staff report dated No- <br />vember 26, 2007. Mr. Miller noted that the volume of properties and amounts <br />were comparable to past years, with approximately 2-5% assessed annually. <br />
