Regular City Council Meeting <br />Monday, November O5, 2007 <br />Page 7 <br />Mr. Miller advised that the funds would be turned back to Ramsey County, and <br />they would disperse them to the taxing jurisdictions. <br />Councilmember Roe questioned whether there would be any interest penalties in- <br />curred if the funds were turned back. <br />Mr. Miller responded negatively. <br />Councilmember Ihlan questioned whether it would be possible to use funds out- <br />side the Centre Pointe District for other types of infrastructure. <br />Mr. Miller responded affirmatively; noting that it was staff's intent, at the upcom- <br />ing Public Hearing, and if the Council determined to move forward, to suggest <br />that the City Council authorize modification of the TIF Plan to preserve their op- <br />tions to reserve as much pooling flexibility as possible for environmental reme- <br />diation or infrastructure improvements. <br />Councilmember Ihlan clarified that it was not possible to use the funds for recrea- <br />tional purposes. <br />Mr. Miller tentatively concurred; however, noted that legal counsel would be <br />available at the upcoming Public Hearing scheduled for December 17, 2007. <br />Further discussion included potential use for pedestrian improvements. <br />Councilmember Ihlan noted that she still had questions on the need to use Centre <br />Pointe TIF monies for Twin Lakes-related environmental clean up when there <br />were two (2) Twin Lakes TIF Districts in existence. Councilmember Ihlan opined <br />that she was not supportive of an additional pool of money that may encourage a <br />majority of the City Council to create another "slush fund" for additional retail <br />development at Twin Lakes. Councilmember Ihlan spoke in support of using cur- <br />rent funding sources and attempting to seek reimbursement from those responsi- <br />ble parties originally contaminating the properties before using public monies for <br />the clean up. Councilmember Ihlan sought further discussion and analysis to de- <br />termine TIF being generated from the two (2) existing TIF Districts for Twin <br />Lakes. <br />Councilmember Roe opined that the City Council needed to be very specific in a <br />modified TIF Plan for Centre Pointe; and asked for staff to provide a copy of the <br />original TIF Plan for the Centre Pointe District; in addition to a formal legal opin- <br />ion on what could and could not be done with those funds, based on the original <br />establishment of the district and current laws. <br />• <br />
