Regular City Council Meeting <br />Monday, December 17, 2007 <br />Page 5 <br />Councilmember Kough opined that the City was violating State Code, but was <br />unable to identify specific code violations. <br />Mayor Klausing asked Councilmember Kough to review his notes for the refer- <br />ences for further review by the City Council and City Attorney to determine com- <br />pliance of City Code and State law. <br />Tam McGehee <br />Ms. McGehee, in the audience, interrupted Council discussion to make reference <br />to a representative she'd spoke with in the MN State Fire marshal's office, regard- <br />ing code provisions in a "book in the library, but not referenced or available on <br />the website," related to Fire Code provisions of 96' cul-de-sac standards without <br />parking, and 120' with parking. <br />Mayor Klausing attempted to obtain further clarification, as to whether this was a <br />recommendation or law. <br />Ms. McGehee opined that the City Council was trying to satisfy one (1) single <br />development by enacting this ordinance amendment, and further opined that this <br />was not an effective way to make policy. <br />Councilmember Roe clarified that the City's standard cul-de-sac width to-date <br />had been 100', and the identified existing cul-de-sacs at 80' in width had not been <br />in compliance to-date. <br />Councilmember Ihlan opined that this was an example of the need for substantive <br />policy discussion prior to making ordinance changes; and further opined that this <br />was being brought up in response to a court order, based on a controversial devel- <br />opment and addition of a cul-de-sac. <br />Mayor Klausing asked Mr. Schwartz if the purpose of this amendment was to get <br />one particular project approved. <br />Mr. Schwartz advised that the purpose of the proposed ordinance amendment was <br />to bring all existing alternatively-designed cul-de-sacs, as identified in the staff <br />report dated December 17, 2007, into compliance with City Code. Mr. Schwartz <br />further advised that the proposed cul-de-sac on Acorn Road would also then be <br />brought into compliance with City Code. <br />Councilmember Ihlan provided several bench handouts, consisting of a web arti- <br />cle from RealEstate Journal. com; and another web article from The New York <br />Times, both related to cul-de-sacs. <br />Mayor Klausing invited public comment at this time. <br />
