PLANNING FILE 07-045 <br />Continuation of the request by Alan Livingston for VACATION OF RIGHT-OF- <br />WAY (AN UNDEVELOPED PORTION OF Rose Place) adjacent to the residential <br />property at 2574 Dunlap Street. <br />Chair Bakeman opened the Public Hearing for Planning File 07-045. <br />Ms. Bloom provided a memorandum dated September 5, 2007 from City Engineer <br />Debra Bloom to the Planning Commission, as a bench handout entitled, "Vacation of <br />Rose Place right-of-way," and included an attached memorandum dated May 7, 1984 <br />from Charles Honchell, former City of Roseville Public Works Director, attached <br />hereto and made a part thereof. <br />City Engineer Debra Bloom reviewed this previous request by Mr. Livingston for <br />vacation of an undeveloped portion of the Rose Place right-of-way (ROW) adjacent to <br />his residential property at 2574 Dunlap Street. Ms. Bloom addressed previous <br />approvals and potential approvals of land use issues, in addition to potential <br />development of the manufactured home park (MHP) north of Rose Place; existing <br />traffic counts and compatibility of the area roadways with that traffic and projected <br />traffic; density considerations; and other potential uses of adjacent properties. Ms. <br />Bloom reviewed connectivity issues of Rose Place and Dunlap Street. <br />Following further staff review, Ms. Bloom advised that staff could no longer support <br />the requested right-of-way vacation, due to the possibility of a redeveloped MHP <br />needing safer access to Lexington Avenue. Ms. Bloom noted that future <br />redevelopment of the MHP may create a need to connect Rose Place to Dunlap <br />Street. However, Ms. Bloom noted that, while the likelihood of this occurring is low, <br />once the right-of-way is vacated, the City would have to repurchase the land. <br />Ms. Bloom further advised that staff had discussed their decision with Mr. Livingston, <br />who had then withdrawn the request. Ms. Bloom noted that Mr. Livingston was in the <br />process of making application for a variance to construct a garage on his property; <br />and advised that staff would most likely support that variance for a reduced setback, if <br />the application was comparable to that verbally reviewed between staff and the <br />applicant. <br />Ms. Bloom also presented the petition signed and received from over forty (40) <br />neighbors and entitled, Petition to Stop Rose Place from Being Built Thru;" attached <br />hereto and made a part thereof. <br />Staff recommended DENIAL of the request for a VACATION of the southern half of <br />the Rose Place RIGHT-OF-WAY adjacent to the property located at 2574 Dunlap <br />Street; based on the comments and findings of Section 5, and the conditions of <br />Section 7 of the project report dated August 1, 2007. <br />Discussion included anticipated placement of the proposed garage; future published <br />and mailed notice for a Public Hearing for consideration of the variance application, if <br />and when received and reviewed by staff; and potential solutions to alleviate traffic <br />issues in the neighborhood. <br />Commissioners Gottfried and Gasongo expressed their appreciation to staff for their <br />further review of this request, and for identifying future solutions for the applicant and <br />neighborhood. <br />Public Comment <br />Sheila Mahnken, 2599 Lexington, #513 MHP <br />
