Planning Commission Meeting <br />Minutes -Wednesday, September 05, 2007 <br />Page 4 <br />past; potential permitted uses as proposed by staff that may create parking issues <br />(i.e., daycare use); attempt to clarify the definition of "physical culture and health <br />services;" clarification of current permitted uses and exclusions in the B-1 Zoning <br />District and that allowed within the PUD: square footage of the proposed bookstore, <br />as well as projected growth potential and plans. <br />Additional discussion included further parking sufficiency for current and potential <br />permitted uses of the facility; accuracy of information on daily customer traffic by <br />applicant; and potential for additional retail in the building. <br />Staff clarified that the building currently had 3,000 square feet of vacant retail space, <br />proposed for the book store use, with a total square footage of the entire building at <br />approximately 10,000 square feet, with office, lab and storage use in the remainder of <br />the building. <br />Applicant, Melissa Olson, book store owner; and Gene Schultz, building owner <br />Mr. Schultz advised that the current Cryogenics facility utilized a total of 4,000 square <br />feet, a vacant 1,600 square feet in the rear of the building, and current space in the <br />lower level to be vacated by the current tenant on December 1, 2007. <br />Additional discussion discussed the availability of twenty-six (26) parking stalls for the <br />facility; employee parking and tenant use; and projected cars for the bookstore <br />averaging 3-4 vehicles at any given time. <br />Chair Bakeman closed the Public Hearing, with no one appearing for or against. <br />Commissioner Doherty opined that permitted retail use should be limited to 3,000 <br />square feet total. <br />City Planner Thomas Paschke opined that staff was advocating for additional low- <br />impact uses as outlined in the proposed list of permitted uses; noting that even if the <br />entire facility became retail, potential tenants would recognize that parking was <br />limited, and only low-impact uses would consider the location. Mr. Paschke further <br />opined that he saw no serious implications to on-site parking; advising that office uses <br />are typically uses that have a greater impact than low-impact, specialty retail uses. <br />Commissioner Gottfried opined that market conditions would self-regulate the site and <br />the twenty-six (26) available parking stalls. <br />Further discussion on possible uses ensued, including call centers or business help <br />line offices; and destination-type uses; and City code regulations for sexually-oriented <br />businesses. <br />Commissioner Boerigter spoke in support of staff's recommendation without further <br />restrictions for permitted uses. <br />MOTION <br />Member Boerigter moved, seconded by Member Gasongo to RECOMMEND <br />APPROVAL of the request for an Amended PUD for Melissa Olson and Eugene <br />Schultz to allow the proposed range of business uses in the multi-tenant <br />building at 1940 Lexington Avenue; based on the comments and findings of <br />Section 5, and the conditions of Sections 5 and 6, and the condition of Section 7 <br />of the project report dated September 5, 2007. <br />Amendment #1: <br />Chair Bakeman moved, seconded by Member Gottfried, to amend the proposed <br />motion to delete "Physical culture and health services" from the list of <br />permitted businesses under the PUD Amendment. <br />Chair Bakeman provided her rationale for deleting this specific use, due to the lack of <br />clarity and definition of the use.
