Planning Commission Meeting
Minutes -Wednesday, September 05, 2007
Page 5
type of use would be that of a spa type business, and not appropriate to this property
and the limited parking availability.
Amendment#1
Ayes: 7
Nays: 0
Motion carried.
Commissioners asked that staff determine definitions of uses and provide that
information with future requests.
Amendment #2
Member Doherty moved that the retail use and expansion be limited to 3,100
square foot total. The Chair declared the motion dead for lack of a second.
Mr. Schultz advised that renting space was a recurring problem due to lack of parking
availability; and noted that prospective tenants are well-acquainted with the number of
parking spaces they require and space limitations of the site.
Chair Bakeman asked Mr. Schultz if he'd allocated a certain number of spaces to
each business.
Mr. Schultz advised that, to-date, he has not made such designations.
Original Motion, as amended
Ayes: 6
Nays: 1 (Doherty)
Motion carried.
b. PLANNING FILE 07-051
Request by Ms. Najmieh Rezakhani for a CONDITIONAL USE PERMIT (CUP) to
allow a hair salon home occupation at 425 Wagner Street.
Chair Bakeman opened the Public Hearing for Planning File 07-051.
Associate Planner Bryan Lloyd reviewed the request of the Ms. Rezakhani, to operate
a small hair salon from her home; and reviewed permitted home occupation uses and
limitations detailed in Section 1004.01 G (Home Occupations) of Roseville City Code.
Staff recommended APPROVAL of a CONDITIONAL USE PERMIT (CUP) for
Najmieh Rezakhani, 425 Wagner Street, to allow the proposed in-home salon, based
on the comments and findings of Sections 5 and 6 of the project report dated
September 5, 2007.
Discussion included American Disability Act (ADA) requirements for non-commercial
property and building permit regulations rather than land use considerations that
would address those issues; and home-based business licensing requirements and
monitoring.
Chair Bakeman requested that staff provide ADA information in the file prior to City
Council review and consideration.
Applicant, Najmieh Rezakhani
Ms. Rezakhani was present, and responded to Commission questions regarding her
intent for the business, future employees and/or growth and expansion. Ms.
Rezakhani advised that she had no intention of adding additional chairs or employees
due to her full-time work; limited space availability (approximately 350 - 400 square
feet); and noted she would not be opposed to the Commission prohibiting outside
employees or limiting the space for the home-based business.
Public Comment
Sheila Mahnken, 2599 Lexington, #513
