The Chair declared the motion dead for lack of a second. <br />Mr. Schultz advised that renting space was a recurring problem due to lack of parking <br />availability; and noted that prospective tenants are well-acquainted with the number of <br />parking spaces they require and space limitations of the site. <br />Chair Bakeman asked Mr. Schultz if he'd allocated a certain number of spaces to <br />each business. <br />Mr. Schultz advised that, to-date, he has not made such designations. <br />Original Motion, as amended <br />Ayes: 6 <br />Nays: 1 (Doherty) <br />Motion carried. <br />b. PLANNING FILE 07-051 <br />Request by Ms. Najmieh Rezakhani for a CONDITIONAL USE PERMIT (CUP) to <br />allow a hair salon home occupation at 425 Wagner Street. <br />Chair Bakeman opened the Public Hearing for Planning File 07-051. <br />Associate Planner Bryan Lloyd reviewed the request of the Ms. Rezakhani, to operate <br />a small hair salon from her home; and reviewed permitted home occupation uses and <br />limitations detailed in Section 1004.01 G (Home Occupations) of Roseville City Code. <br />Staff recommended APPROVAL of a CONDITIONAL USE PERMIT (CUP) for <br />Najmieh Rezakhani, 425 Wagner Street, to allow the proposed in-home salon, based <br />on the comments and findings of Sections 5 and 6 of the project report dated <br />September 5, 2007. <br />Discussion included American Disability Act (ADA) requirements for non-commercial <br />property and building permit regulations rather than land use considerations that <br />would address those issues; and home-based business licensing requirements and <br />monitoring. <br />Chair Bakeman requested that staff provide ADA information in the file prior to City <br />Council review and consideration. <br />Applicant, Najmieh Rezakhani <br />Ms. Rezakhani was present, and responded to Commission questions regarding her <br />intent for the business, future employees and/or growth and expansion. Ms. <br />Rezakhani advised that she had no intention of adding additional chairs or employees <br />due to her full-time work; limited space availability (approximately 350 - 400 square <br />feet); and noted she would not be opposed to the Commission prohibiting outside <br />employees or limiting the space for the home-based business. <br />Public Comment <br />Sheila Mahnken, 2599 Lexington, #513 <br />
