Regular City Council Meeting <br />Monday, Apri114, 2008 <br />Page 21 <br />suggested, in order to gain majority support of the Council for passage of the pro- <br />posed ordinance at tonight's meeting, adding two conditions to require a report to <br />the City Council whenever a court citation was issued to allow their monitoring <br />throughout the process; and to implement this on a trial basis (i.e., 6 - 9 months) <br />before making it permanent. <br />Mayor Klausing questioned if the Council majority was prepared to take action <br />tonight without further refinement by staff, specifically in the administrative <br />ticket language. <br />Councilmember Pust asked that the City Council not take action tonight, pending <br />discussions with the HRA for participation and funding stream options. <br />Mr. Trudgeon advised that, due to agenda items, he hadn't anticipated bringing <br />this to the HRA until their May meeting; noting hiring timeframes for seasonal <br />staffing during the summer months. <br />Councilmember Roe spoke in support of the administrative fine structure with es- <br />calating fines, depending on funding sources or budget amendment; expressed <br />willingness to consider a trial implementation for the court citation process based <br />on past discussions of the City Council on the amount of staff time and the time- <br />consuming nature of the current citation process; was supportive of a one year <br />trial period to determine variables and not diminish review of the overall process. <br />Councilmember Roe supported further review of the designated hearing officer <br />for land use and code enforcement issues; and recommended holding off on the <br />citation process until it was determined how the other options work out. <br />Mayor Klausing clarified that his past objection on the court citation process was <br />not related to timing, but City Council involvement in that process, creating fur- <br />ther delays. <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn provided a bench handout representing his perspective on staff's <br />proposed language and a process scenario for the proposed process and opined <br />that the proposal was a travesty with such a process by-passing the City Council. <br />Mr. Kysylyczyn referenced Prosecuting Attorney Carolyn Beckman's comments <br />on such a proposal in a letter of January 18, 2002 to the City Council; with Mr. <br />Kysylyczyn alleging that staff was not providing an honest interpretation of those <br />comments. Mr. Kysylyczyn also referenced the creation and intended use of ad- <br />ministrative tickets, and suggested further City Council review of that intent; and <br />recommended that they also review the City of Maplewood's model for code en- <br />forcement; as well as reviewing past action of the HRA and pending implementa- <br />tion. <br />
