Mr. McGillis reiterated the number of regulatory requirements and par- <br />ties involved in monitoring compliance. <br />Mr. McGillis offered to answer specific questions of the City Council. <br />Norm Jones, with the firm of Winthrop and Weinstein, Attorney for the De- <br />veloper and Developer Partner Mike Swenson, was also present to respond to <br />City Council questions. <br />Councilmember Pust addressed her interpretation of the Agreement and a certain <br />percentage of tenants (60%) meeting income guidelines. <br />Mr. McGillis responded that the regulations indeed required a certain percentage <br />to meet the threshold; and the developer's application for project financing and <br />determining what the right percentage should be, based on the tenant profile when <br />they purchased the property, and their expectations of affordable units upon com- <br />pletion of their renovations; with those numbers respectively represented in the <br />Agreement upon election, and identified tax credit units upon completion. <br />Councilmember Pust clarified that she was understanding the facts correctly and <br />in the right context, and that the developer had been told by their legal advisors <br />that they were meeting the requirements of the program; and in doing so, they had <br />raised some rents. Councilmember Pust opined that she was inclined to consider <br />this as a landlord/tenant dispute. <br />Mr. McGillis concurred with Councilmember Pust's interpretation of the provi- <br />sions of the Agreement as indicated. <br />Councilmember Ihlan questioned where she would find specific information in <br />the application of rent provisions. <br />Mr. Norm Jones, Attorney for the Developer responded that the information was <br />part of the application packet submitted to the MHFA, Form HTC-l, and also <br />submitted to the City of Roseville for issuance of the 4-1M letter; both documents <br />that should be available in the City's file; with that form providing target rents <br />and the target amount of restrictions on each unit type. <br />Mr. McGillis advised that the documents would have been dated sometime in July <br />of 2007. <br />Mayor Klausing opened the floor to comment from Mr. Jack Cann <br />Mr. Cann alleged that the owner had given a large number of eviction notices, <br />with tenancies terminated at the end of this month without reason; and sought to <br />know why, how many, why and if they're claiming that those tenants are over in- <br />come, how can they be after saying that 25% of the residents don't have to meet <br />low income requirements.
