Regular City Council Meeting <br />Monday, November 24, 2008 <br />Page 8 <br />Mayor Klausing opened and closed the Public Hearing at 6:34 p.m., with no one <br />appearing to speak. <br />b. Public Hearing Regarding Liquor License Renewals <br />Finance Director Chris Miller highlighted the Request for Council Action dated <br />November 24, 2008 for renewal of ten (10) off-sale intoxicating, twenty-three <br />(23) on-sale intoxicating, four (4) club, nine (9) wine, fourteen (14) on-sale 3.2 <br />non-intoxicating malt liquor and eight (8) off-sale 3.2 non-intoxicating male liq- <br />uor licenses for calendar year 2009. Mr. Miller advised that licensees applying <br />for renewal had been notified of tonight's public hearing. As requested by an in- <br />dividual Councilmember, a matrix of each business, whether they participated in <br />city-provided optional training, and their history of compliance checks was pro- <br />vided to the entire Council and public as a bench handout. <br />Mayor Klausing opened the Public Hearing at 6:35 p.m. <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn sought a verbal summary of the information just now being dis- <br />tributed, and Mayor Klausing reviewed the bench handout, with a public copy <br />made available. <br />Mr. Kysylyczyn asked if the City Council had a legal obligation to renew the Da- <br />vanni's alcohol licenses, given their history of and excessive ranking of compli- <br />ance check failures, and their continuation during the most recent "alcohol scan- <br />dal" of continuing to serve liquor after license revocation. Mr. Kysylyczyn <br />quoted City Attorney Scott Anderson's past comments that it was a privilege, not <br />a right, to receive a license to sell in the community; and noted that previous <br />comments of the local Davanni's manager in opining her lack of interest in selling <br />alcohol, but citing corporate practice and requirements to do so. <br />Mr. Kysylyczyn further referenced Fuddruckers and their history of compliance <br />check failures; and the upcoming agenda item to deal with their latest failure; and <br />asked that the City Council strongly consider not renewing the licenses of either <br />firm, or await action on those two (2) specific licenses until additional informa- <br />tion is available to the City Council for considering those particular license re- <br />newals. <br />Mayor Klausing closed the Public Hearing at 6:40 p.m. <br />13. Business Items (Action Items) <br />a. Consider Certifying Delinquent Utility and Other Charges <br />Councilmember Willmus noted that a property on Prior had a fairly significant <br />charge, and questioned the regularity of that high of a fee. <br />
