Regular City Council Meeting <br />Monday, December 15, 2008 <br />Page 20 <br />tares and Old Dominion, when they were not beneficial to the City, not the City's <br />taxpayers who were paying for staff time for this private transaction. <br />Mr. Bahls opined that if the vacation and re-granting agreement were not ap- <br />proved, they would consider that the City did not own that ten foot (10') strip. <br />Further discussion included utilization of the ten foot (10') strip of land as part of <br />the Iona Lane construction and right-of--way in the near future; timing for access <br />and recording purposes; the need to move as expeditiously as possible; Metro <br />Transit's institution of condemnation proceedings to proceed with the Park and <br />Ride facility; and clarification by staff that the condemnation was specific to Lot <br />1, Block 1, not the ten foot (10') strip of land. <br />Councilmember Pust reiterated her concern in City staff being used to work on a <br />private project that didn't benefit the City, when the developers should have nego- <br />tiated the situation on their own. <br />Mr. Bahls advised that one of the frustrations of both City staff and his office was <br />in dealing with the County surveyor and what they would accept, and their at- <br />tempts to work around that hurdle, necessitating putting together this short-term <br />agreement. <br />Klausing moved, Ihlan seconded, approval of the VACATION and RE- <br />GRANTING AGREEMENT between the property owner (Old Dominion) and the <br />City of Roseville; subject to the condition in Section 6 of the project report dated <br />December 15, 2008. <br />Roll Call <br />Ayes: Ihlan; Willmus; Roe; and Klausing. <br />Nays: Past. <br />Motion carried. <br />Klausing moved, Ihlan seconded, approval of the FINAL PLAT for Cent Ven- <br />tures II and the property at 2750 Cleveland Avenue; based on the comments and <br />conditions of Section 6 of the project report dated December 15, 2008. <br />Roll Call <br />Ayes: Ihlan; Willmus; Roe; and Klausing. <br />Nays: Past. <br />Motion carried. <br />e.
