is on the HRA Board, was the coordinator with the HRA for Bremer Bank and works <br />at Bremer Bank.. Banks have a very strict policy regarding Conflict of Interest and <br />I thought the City did also.(See Attachment B) <br />MICHAEL KI-EMM,AT1'ORNEY FOR THE ASSOCIATION <br />Mr. Klemm sent a letter dated September 30, 2008 to Mark Lindberg, President (See <br />attachment C) <br />Mr. Klemm said "The Directors are legally obligated to comply with the allocation of <br />costs established in the Second Amended Declarations, and failure to do so could <br />result in a lawsuit by one or more Unit Owners against the Association and against <br />the members of the Board of Directors in their individual capacity" THAT IS TRUE. <br />However, the bid does not follow the Declazations or the State Statutes. <br />. (See attachment A -items being divided by 47 not following theStatutes/Declarations <br />4. THE NEW DECLARATIONS ARE WRITTEN FOR CONDOS BUT NOT <br />TOWNHOUSES <br />WHAT'S THE DIFFERENCE BETWEEN A TOWNHOUSE AND A CONDO? <br />People buy townhouses so they own their own home and do not have to take Gaze <br />of common property which is the pool, ground and roads. More importantly, each <br />townhouse owner owns the property their unit is on. In no way do they own, have <br />rights to or benefit from the other homes. The inside and the outside of a tovmhome <br />is limited common property. The Board cannot change limited to common property <br />In a condo, the property is owned by the association, which is the major difference. <br />(See attachmentD the Plat for WWV1) <br />5. EXAMPLE OF HOW THE BOARD OPERATES: <br />Our Board asked the members to come.to a meeting to vote on the new Contract with <br />the City. No information regarding the contract of about 15 to 20 pages were sent out <br />by the Board so we could read, take to our attorney or accountant. However, a newly <br />elected Boazd member who said when he ran, "I will be transpazent" decided on his own, <br />because the Board did not send a copy of the contract, , to send the contract. Any attorney <br />would tell their client to read before agreeing to a contract. <br />The Board said they needed to explain, as "we would not understand." The arrogance. <br />In other words we will tell you how to vote, we will tell you what we want you to know, <br />you do not need to read, think for yourself.
