. i , Because a list of permitted, conditional, or prohibited uses was never established for this
_ PUD, Community Development staff has been unable to give clear guidance to the
1 property owner regarding how the property may be used; each new, proposed use has,
i therefore, required Planning Commission and City Council approval.
- _ On January 29,2006, the City Council adopted a resolution to eliminate the PLANNED
UNIT DEVELOPMENT on the subject property (2435 — 2459 Rice Street), thus allowing
the zoning designation to return to Retail Business (B-2) District; this zoning
classification will again designate what uses may be allowed on the property.
u. Child daycare centers are conditionally permitted in the Retail Business (B-2) District.
I , At their meeting on February 7,2007, the Roseville Planning Commission held the public
hearing regarding this request; no citizens addressedthe Commission at the public
_ hearing. This requirement is considerably less than for general retailoffiee
t uses, and because parking at the strip center was approved for such general retail uses,
i the elimination of a few spaces far the proposed play area should not cause a parking
shortage for any of the current or possible, permitted future uses.
ti ;. x Furthermore, the parking needs of a child daycare center are predominantly limited to
a times when children are dropped-off and picked-up. To accommodate these maneuvers,
'; the proposal includes marking a one-way drive lane between the two parking lot
. entrances accessing Transit Avenue.
_. . The Fire Marshal has determined that emergency access is adequate without utilizing the
. existing drive lane behind (i.e., west o the strip center.
' Pursuantto $1013.01(ConditionalUse Permits) of the City Code, the Planning
t Commission and City Council must consider six criteria, set forth in the City Code, prior
ti to issuing a CUP; these criteria are discussed in section 6 of this report
;= .Q REVIEW OF CONDITIONAL USE PERMIT CRITERIA
ti f.
