Litigation Update Regarding Axel's Charhouse Alcohol <br />Violation Appeal; and Litigation with the Twin Lakes <br />Developers <br />Present: Councilmembers Roe; Pust; Ihlan; and Mayor Klausing. Also <br />present: City Attorney Scott Anderson; City Manager Bill Malixxen; and <br />Finance Director Chris Miller. <br />City Attorney Anderson advised that the Open Meeting law requires the <br />City, prior to closing a meeting, to state the grounds allowing closure and <br />to describe the subject to be discussed. City Attorney Anderson advised <br />that according to Minnesota Statute Section13D.05 of the Open Meeting <br />Law, closure was permitted under the a�tarney/client privilege. City <br />Attorney Anderson described the subjects to be discussed as a report <br />from City Council members Pust and Ihlan on the meeting they took part <br />in with Counsel for the City with the opposing parties in the Twin Lakes <br />Litigation, and the analysis of the positions set forth in the meeting and <br />potential City responses. City Attorney Anderson also indicated that the <br />subject to be discussed regarding the AYeI's Charhouse Liquor Violation <br />related to the status of the proceedings, analysis of occurrences during <br />the pendency of the proceedings to date, and potential City responses. <br />Mayor Klausing opened the Special Meeting in Open Session. On a <br />unanimous vote (4/0), the meeting was closed and the Council convened <br />in Executive Session at 5:3�p.rn. City Attorney Anderson then spoke to <br />the Council regarding the offer of settlement in the pending appeal. <br />Mayor Klausing adjourned the meeting at 6:15 p.m. <br />
