All notices and orders shall comply <br />with Section 107. <br />110.3 Failure to comply. If the owner of a premises fails to <br />comply with a de�tolitipr� order within Ll3e ti�e prescqbed, the <br />co�e r�f�cja} shall cause the structure to he demolished and re- <br />moved, either through an �vailable public agency or by contract <br />or a�-rangement with private persons, and the cost of such de- <br />t�solitiots and removal shall be charged agauisC the real estate <br />upon which the strucmre islocated ard s1�a�2 be a iieri upon such <br />red� estate. <br />11Q.4 Sal�age materials. When any struct�3re ltas beenordered <br />demolished and aentovea, the governing body or other desig- <br />nated offic erunder said contract or arrangement aforesaid s�all <br />have the xight lo sell the salvage and valuable materials at the <br />highest price obtaivable. The net proceeds pF such sale, after <br />deducting the expenses of such demoIitio� and removal, shall <br />4°• promp€ly �emitted wit{t a report of such sale or transaction, <br />in :Iuding the items of expense and tbe amounts deducted, for <br />the person who is entitled thereto, «�b�� to any order of a <br />court. Ifsuch a surplus does not remain to be turned over. the re- <br />port shall so slate. <br />s�c�EOrr ii i <br />MEANS OF APPEAL <br />1111 Application for appeal. Any persondirectly a$ected by <br />a decision of the code official or a notice or order issued �k��z' <br />this code shall have the right to appeal to the board of appcals, <br />provided that a written �p�li caiion for appeal is filed within 20 <br />days after the day the decision, notice or order was served. An <br />application for appeal shall he basad pn a clai�n that the true in- <br />tent of this code or the t�ules legally adopted thereunder have <br />been incorrectly interpreted, the provisions of this code do not <br />fi�ily apply, or the requirements of th�s code are adequately sat- <br />_> isfied by other means. <br />17 �..2 Membersf�ip of board. The board of appeals shall corl- <br />sistof a minimum of three members who are qualifiedby expe- <br />€�enee anc� irai�ing to pass on matters pertaining to j.^ �o: ii t' <br />maintenance and who are not employees of the jur�sdictiur,. <br />The code pfFiciai shall be an ex-officio member but shall l�ave <br />no vote on any matter before t��. board• The board shall be ap- <br />pointed by the chief appointing authority. and shall serve stag- <br />gered and overlapping terms. <br />l ll.21 Alternate members. The board shall annually se[ect one of :"' I <br />its members to serve as chairman. <br />l ll.2.3 Disqualification of inember. A member shall not <br />hear an appeal in which lhat member has a personal, �rofes- <br />sional or financial interest_ <br />1ll.2.4 Secretary. The chief administrative o�eer shall <br />designate a qualified person to scrve as secretary to the <br />board. The secretary shall ft.le a detailed record of all pro- <br />cee�ti�xgs in the n�fce of i�t� c�ef administrative officer. <br />J11.2,5 Compensation of inembers. Compensation of <br />members shall he determined by law. <br />111.3 Notice of ineeting. The board shall meet upon notice <br />frot� the ch axr�an, within 20 days of the filing of an appeal, or <br />at stated periodic meetings. <br />111.4 Open hearing. All hearings before the baard shall be <br />open lo the public. The appellant, the appellant's representa- <br />tive, the code official and a�y person whose interests are af- <br />fected shall be given an opportunity to be heard. A quorum <br />shall consist of not less than twathirds of the board mem6er- <br />ship. <br />l ll.41 Pr�cedtar�, �h� hoard shall adopt and make avail- <br />able to the public through the secretary procedures under <br />w[�ich ahearing will be conducted. The procedures shall not <br />require complrance with strict rules t�# evidence, but shall <br />mandate lhat only relevant information be received. <br />111.5'gostponed he�ting. Copies shall t�ef�t���shed to the appellant <br />and [4 the code official. <br />111,G.2 Administratip�, The codc offacial shall take i�n�me- <br />diate action in accordance with the decision of the board. <br />111.7 Court �•evie�v. Any person, whether or not a previous <br />party of the a��eal, shall have the right to apply to i�e a�propri- <br />ate couxtfo�' a writ of certiorari to correct e�rpxs of law. Applica- <br />tion for review shall be made in the manner and time required <br />by law following the filing of the decision in the o�ceof the <br />chief administrative o�cer. <br />1ll.8 Stays of enforcement.
